Hello Friends,

I am currently residing in Montreal. I am on Open Work Permit and have TRV too. I am looking forward to call my spouse here in next year. She is currently in India.

I am planning to go to India around Feb-2015 and do the court Marriage. Then, I will call me wife here around October-2015.

I am not sure about on which Visa Category she will com here and will she be allowed to work immediately or not. I mean she has to apply for TRV as well as Open Work Permit at the same time.

Senior members, please advise me over this. Am I planning correctly. Looking for Serious advise. Help me folks.

After marriage, if you are still on an open work permit (i assume it is a PGWP), then you need to show a skilled job (NOC 0, A or B) in order for your spouse to apply for a SOWP from India. That will get her the eligibility to work in Canada. Every one who comes from a non visa exempt country, when they apply for study or work permit, they get trv along, since that is a requirement to enter Canada.

Hence your spouse would get a SOWP along with a trv to enter Canada.

Please note that she would apply in India and processing time for her local CIC embassy would apply.

If by that time you have become a PR (but not married so your spouse is not a PR), then you would only be eligible for SOWP IF YOU HAVE applied for spousal sponsorship IN LAND i.e. submitted in Canada.
