My friend submitted a application to sponsor his new married wife, who just met in two or three months, and he failed to disclosure that he had a previous common law relationship.

Besides misrepresentation, the marriage is apparently for the immigration purpose no matter the relationship is genuine or not.

He submitted the application in April 2021 but only received a temporary file number since then. He went to see the MP in Oct 2021 and was notified that IRCC found his failure to disclosure the previous common law relationship.

Now it has been a year and half, I suggest him to see a lawyer. Besides that, does any body have similar experience or advice to share?

So in October 2021, what did your friend do? Did your friend receive a procedural fairness letter and need to respond?

Your friend needs a lawyer because if PFL was received and not responded to, there may be a ban for misrepresentation. And after a year, nothing your friend can do.

Hi, How the immigration found about common law? if it is not genuine marriage, first this is wrong. second, the guy can be in trouble even after 3 years of the spouse's arrival in Canada. if only fail to disclose common law can be sorted out and not affect this relationship but you are saying that this is for immigration purpose only that make it very fishy. unless he can prove that the marriage is genuine with all the documents, pictures etc.

He didn’t receive a PFL last year, but the call centre agent told him that the case delayed because he failed to disclosure the previous common law relationship.

Now he doesn’t know what to do except waiting until receiving another advanced notice.

When he logs on what is the status of the file? Order ATIP notes to find out VOs findings . Honestly why has he waited a year? Call centre agents aren’t IRCC officers so should have looked into this a year ago about delay. Misrepresentation is a bid deal.
