Sponsership for Brother with Autism

Hi All...
I am also in a similiar fix, request your help on this
i got the PR for me, wife and daughter and expiring in Nov 15, but still not able to decide whether to move or not
my brother has autism and he is 24yrs old, unmarried. if i move to canada, i can call my parents after 3-4 yrs depending upon financials but dont know whether brother would be allowed to come along. he is dependent and has nobody back here to look after. if he is not granted visa, i wont be able to call even my parents, not even for few days

can anyone help me to give some clarity that dependent brother can be given visa

Unfortunately there is no black and white answer to your question.

It's really impossible for any of us to say whether you will be able to sponsor your brother or not. Although your brother is older than 19, it sounds like he would fit the category of a Type 2 dependent who has been dependent on your parents since before the age of 19 due to a physical or mental condition. However even if he is accepted as a dependent, he may be refused due to being an excessive burden on Canada's social and health care system (if he's refused your parents will be refused as well). If your brother's condition is so severe that he cannot live on his own even for a few days - then my guess is that he would be refused on excessive burden grounds.

None of us can tell yo for certain what will happen. However there is certainly no guarantee you will be able to sponsor your parents and brother later. It may not be possible.

To specifically answer your question, yes, he can. However, as Scylla said, no one can tell you for certain either way but there is a good chance he will be refused due to an excessive burden on Canada's social/health systems.

Typically, to be approved for a tourist visa you have to show that you have strong ties to your home country (e.g. job, property, assets) and have no plans on remaining in Canada long-term. You must also prove that you have sufficient funds to pay for your visit to Canada. So there is no guarantee your brother will be granted a tourist visa. I would assume it may not be possible due to your brother's condition.

2. If you are asking about PR - no, there is no such process. If you apply to sponsor your parents for PR and include your brother - and CIC then sends you a fairness letter stating they plan to refuse the application based on your brother's condition, you will have to prove (with letters from medical / health care experts and other evidence) that the medical and/or social benefit costs of your brother's care will be less than $6,500 per year.
