Hi,

I am bit confused what to do. If anyone can help. I came to canada on SOWP. But when I landed here I came to know my wife don’t want to stay with me anymore due to her personal reasons. And she filed one sided divorce back in India. After having conversations with her family I was left with no choice to mutually take divorce else they threaten they will ruin my PCC with false accusations.

My concern is now I’m divorced. I have one year work experience in Canada. But I’m on SOWP and my permit is good for next year. Can I apply pnp if I’m on SOWP but now I’m divorced ??? Or I have to find any other alternatives?? Divorce was not my choice unfortunately but I’m on SOWP. I understand I have my status until my permit expires but meantime can I apply pnp on my behalf ? I’m already so depressed due to what happen and now for my future I don’t know what to do please help if anyone in same situation or anyone who can guide through.

I’m really sorry to hear about what you’re going through. Navigating your immigration options after an unexpected divorce while on a Spousal Open Work Permit (SOWP) can be challenging, but you do have options to secure your future in Canada.

1. Eligibility for Provincial Nominee Program (PNP): Generally, most PNPs allow individuals who have Canadian work experience to apply, even if they’re on a SOWP, provided they meet other program criteria (such as the type of job, NOC skill level, or a job offer requirement in certain provinces). Your marital status won’t affect your eligibility for PNP as long as you’re meeting their criteria independently.
2. Express Entry: If you’ve gained enough points (from work experience, language proficiency, education, etc.), Express Entry could be another option, though the Comprehensive Ranking System (CRS) score required can be high. Express Entry applications are based on individual credentials and aren’t affected by your previous SOWP status or marital situation.

3. Employer-Specific Work Permit: You may want to explore applying for an employer-specific work permit if you have an employer willing to support you, especially if you’re not eligible for PNP programs without a job offer.

4. Maintain Status and Seek Support: While you still have legal status on your current permit, you could use this time to work toward meeting the criteria of other immigration pathways, including improving your language scores or gaining more work experience.

5. Consult a Professional: Given your unique situation, consulting with an immigration consultant or lawyer could help you tailor the best path forward. They can provide guidance on PNPs you might be eligible for, and advise on any potential challenges specific to your case.

The fact that you’ve already gained Canadian work experience is positive and may provide you a solid foundation. Keeping your focus on gathering strong supporting documents for any application will be key.

Hi,

Thank you for replying. This really gives me hope in dark. I meet the criteria of Mpnp. I also have my real brother in Manitoba who is permanent resident. I have secure 681 points and I’m waiting for the draw. I was bit concerned as I got divorced if this will impact my file as I’m on SOWP and divorced. Divorce was not in my control hoping for the best that mpnp will support me.

Zero impact on anything. CIC knows that divorce happens, relationships break down. It won’t have any impact. Make sure you include divorce certificate with application.
