Hello everyone!
I got my PR last year-july 10/2014. I have a 12 year old girl in the philippines and was only declared as non-accompanying dependent when i applied since her father didnt sign all the documents that i needed to submit that time. My question is,how can i get her full custody? we are still married and i only divorced him in canada. will a notarized written custody be enough and satisfies the immigration requirement? or should i file a petition for sole custody? I am coming home in march but i dont think 3 week vacation is enough for me to comply all the requirements needed. pls enlghten me,i tried to call his attention but his girlfriend said he wont sign the papers.

Thank u. I will do it once i get there. But i have one more question if its true. A friend of mine who is working in tje catholic social services just called me that based on my divorce it was stated there that i have the sole custody of my child and that she will reside with my parents. Is there any truth in it? She said that since canadian embassy is the one that will process all the application i have a greater chance to get her . If anyone who had this sutuation pls response. One more thing is that there was a form that her dad needs to sign what will i do with that if he wont sign? Or do i still need to fill it if the sole custody tjat was stated in my divorce is valid? Pls eveyone. :(. Leon, computergeek.

Sole custody is not the only thing you need here. It sounds as if her father is in regular contact with both you and her. Canada won't be a part of taking a child from a parent without that parents consent. Your best viable option is to convince her father that this would be a good opportunity for her, that she might better her life and that she can still visit him and so on and so forth. Remember, this is not just about you and/or your daughter, but that father of your child. You know how you feel about not being able to bring her with you currently, imagine how he will feel when he's not able to see or be with her any longer. Both parents love their child equally (for the most part, not always). Try to resolve the problem with the least amount of upset to your daughter, she is unwittingly caught in the middle of this.
