Skilled worker Family Points

Hi Everyone.

Currently, i am student in Montreal and thinking to apply for Regular skilled worker program. My family did refugee case here but was rejected, now they have appeal the decision and waiting for the decision from 8 months. I am just wondering can i claim 3 family points or not, as they all are currently living in Montreal? Any response would be appreciated.
