Hi,


I am looking for an advice for an application under Express Entry category to obtain permanent residence of Canada.

My sister who is a single mother (Divorcee) applied and qualified for Express entry visa. However, they requested consent from childrens (two boys) biological father for the kids to be moved to canada. As per court order from India, my sister has the legal custody of both the childrens. We are not able to obtain consent from the father. Is there any other way by which the application can be accepted without the consent form.

Was she awarded SOLE custody? If not, she will probably need to apply for that in order to remove the biological father's parental rights. IRCC is very strict about parental consent.

As per decree of divorcee, the minor children will remain in her custody and she will look after them . She will not claim future maintenance and there is no litigation pending between them.

I guess this qualifies for sole custody?

Probably not. That doesn't specially state that the other parent's rights are terminated. See a lawyer.
