Hi friends,

The immigration officer in Singapore sent me a letter as follows:

I am concerned that you have misrepresented the following material facts:

1. The employment letter related to your work history from ... to ... appears to be fraudulent. The body of the letter has been copied word for word from NOC 0111
...
Should you wish to address these concerns you may forward to this office my documents that you feels answer the concerns outlined above

...


I apllied for NOC 1122 and submitted 2 reference letters of the most recent jobs under this NOC but the IO questionned me about the reference letter under NOC 0111 of my job 10 years ago.

Please help to tell me the way to answer this or prove my reference letter is accurate.

Does anybody have the same problem or experience to reply this stuff?

I have the same case... Mine was misrepresentation because of the heading of my COE... Now I'm really clueless if I can re apply again... I hope someone can comment on this... Does misrepresentation means inadmissibility? are we banned for two years? I notice your name is littleKYLE... Hehe! Nice!

Mine... I sought advice from an immigration consultant. They analyzed my case. I paid for their services in making my AFFIDAVIT OF EXPLANATION... but to no avail, they still refused it indicating that documents were misrepresented... My question is? Am I inadmissible? Can I reapply again... Or willmi wait for two years... Please anyone

Hi Kyle,

Conclusion: all KYLEs did and will misrepresent his/her document ;-(

The IO let me 60 days to answer his letter but unfortunately the letter came to me almost 6 weeks after the issued date. So, I have only 1 week to 10 days to reply but don't know what to do as I try to contact by email my ex-boss in France who signed the reference letter to ask for writing a confirmation of my job description but no reply from him yet.

Do any of you have any experience to reply this request? I think the IO's impression is quite subjective of himself and he can check it by contacting the signer of the reference letter as I attached the signer's name card together with the letter if he wants to.

Thanks for any comments.

Document Fraud (Misrepresentation)

It is a serious crime to misrepresent yourself by making false statements, or submitting false information or false documents when dealing with CIC.

Document fraud includes both false and altered documents, such as:

passports and travel documents
visas
diplomas, degrees and apprenticeship or trade papers
birth, marriage, final divorce, annulment, separation or death certificates
police certificates
Lying on an application or in an interview with a CIC officer is also fraud and a crime.

The Government of Canada has officers in Canada and overseas who are highly trained to detect fraud.

If you submit false documents or information, your application will be refused. You will also face serious consequences. Depending on the situation, these may include:

no entry into Canada for at least two years
a permanent record of fraud in CIC’s database
having your permanent resident status or Canadian citizenship revoked
being charged with a crime or
removal from Canada

it was stated that regardless if it's you or someone else sent a misleading documents, they will still count you among the inadmissible group... that would mean 2 years banned. i don't want to conclude on this, but since you said you are "IN PROCESS" already, that would mean, they overlooked/haven't noticed the MISREPRESENTED DOCUMENT from your consultant that you are saying... hope for the best! :D

@shah0207 - those are the posted references of your question regarding "TWO YEARS BANNED"...
@little kyle - try hard to contact the one who made the reference letter. That such words in the letter originated from the agency/company you are working at. And that they have no motives of misrepresenting you in any way. Now, it's not sufficient that you depend alone from your employer's response. You should also seek for an immigration lawyer/consultant or anyone who is expert in making an affidavit of explanation...

they have given you 60 days and 16 days are left.
which NOC did you apply in? you have no other ways left other than newly listing ( rewriting) the duties for that particular job. I guess youre a native English speaker so it would be pretty easy for you to rewrite.

you are lucky that your VO has not rejected you straightaway. if he wanted to, he could have easily one that .
there are ways to list the duties in every NOC.

that affidavit would help for sure but only with a newly written jobs and duties list. its usual that your ex boss in France wouldnt reply. sign it by your then manager,supervisor.
