Hi,
I am applying for SOWP.
If my current employer of home country grant my leave of absence and write on the letter as:

Considering a prospective employee for us, the leave of absence has been approved from 1st August, 2014 to 31st March, 2016. Upon returning after leave, we will offer him the “Lead Applications Programmer” position with attractive salary and benefits.
Will it consider as country strong tie?

Thanks!

Isn't this a Workers thread? Please post it there: http://www.canadavisa.com/canada-immigration-discussion-board/foreign-workers-b10.0/

(Do they ask you for "strong country ties" for spousal open work permit? Isn't that contradictory? Please ignore this and carry on to the appropiate forum :) )

As per I know that spousal open work permit comes with TRV (In case of my country). Work permit will be given at port of entry. So, for TRV, I must show strong country tie. That's why I posted here. Please help me to know.. may it be consider?

Thanks!

As far as I know those TRV and SOWP are two different documents that have to be filed separetly.

But OK, short answer: NO, it won't.

A strong tie is something that forces you to go back. In this case your employer is just hoping you will be back but nothing "ties you" to that position, in fact you can go back and not use that option.... see? no tie....

Thanks for your answer!

Can you suggest that in which way a job in home country can work as country tie?

That you are forced by a contract to go back. I know some people get a leave of two years and leave their houses on lieu, if they don't go back they lose their houses. That is a STRONG tie. Other cases in study permits are where the company is paying for the degree, if they don't go back the expenses are conisdered a loan and they have to pay them with interests.

I can't think of nothing else.

That's a great IDEA!! But I do not have any house in my name. I have a cultivated land in my name which I purchased last month to show another point of country tie. Can I use it in the contract?
Thanks!

I have no idea. You have to ask your employer and see what you can do.

Hey Jalex,

I talked with my employer he is agree to give me a paid vacation (50% of basic) for 20 months to go to Canada for having valuable working experience as a professional development as well as accompany my wife in Canada who is a full-time student there.

BUT I need to sign an agreement where:
1. I must grant to the Employer a continuing lien on a property of mine as security. If I fail to come within vacation they will terminate from employment and will claim for Lien (sell the property for the money they paid me).
2. After returning, I must work for 4 years in their company.
3. They may not accept any requests to extend the leave of absence unless I show inability to work because of proven sickness or injury.
4. If I can show at least one year foreign working experience in IT industry in this vacation time, the Employer will offer “Lead Applications Programmer” position with higher salary.
5. During the period of absence, the Employer reserves the right to terminate me without any cause and, consequently this Agreement shall be void.

Now, my questions are:
1. Will it now work as strong country tie?
2. May this agreement effect my PR application in future?

Thanks again!
1. No it can't. Point 5 sounds like a clear back door.
2. I don't have an idea, but weren't you going to go back to your country?

Thanks for your reply!
Honestly, I am already prepared for FSW. My self calculated points is 72 (ielts, Masters, 4 years exp, wife ielts, age). As my wife is now studying in Canada so, I want to go there and then apply for PR when I get a chance. I will manage my employer in some how (like going back and pay their money with some extra).

About point 5. Actually every Private employer has right to fire any employee when they want. It's AT WILL rule. So, do you think the point 5 should not include there?

Well the problem is that you are not a genuine visitor so putting together womething that shows you are is hard.

The letter is better than nothing. Regardless it sounds weak and easy to just ignore it. It doesn't seem your employer is too interested in having you back, it sounds more like it would be good if you come back. That doesn't help.

Good luck.

I understand.

You mean the point 5 is making this agreement very weak? if it is excluded then it would be more strong?
There is also another point:
(e) Amendments: This Agreement may be amended by the parties only by a written agreement
How does it sounds?

Sorry for bothering..
