Hi,

I have a FSW application since October 2010 visa Buffalo which is going no where. I recently got married to a canadian citizen and applied through Spousal sponsorship too. Can my wife get in touch with an MP in Canada in regards to our FSW application and see if they can get an answer as to why my FSW application is not moving forward? Thanks.

If you look at the processing times at http://www.cic.gc.ca/english/information/times/perm/skilled-fed.asp#west you will see that the processing time for files after they added the most wanted list is 25 months. You are still at 16 months so while you are still well within the advertised processing time, I do not know what an MP can do for you.

The 25 months is from Nov 2008 to June 2010. Did CIC not promise to complete the PR process for FSW in less than a year after June 2010?. Thanks.

Agreed the data is for pre june applicants between nov 2008 and june 2010.

No, actually they promised that they would try to complete it in less than a year after 2008 but they have not succeeded.. yet :)

Do you mean for those who filed their applications after 26/6/2010 it can even take 25 months or more for them too?

But the link says

then how do you say post 26/6/10 applicants are also taking 25 months to complete?

I think leodr you should contact your MP? because if you look at other post 26/6 applicants they are getting visas in an year's time.

They say not enough of them are done yet to give a timeline but I fail to see why after June 2010 should be faster than before June 2010. They already had the most wanted list since 2008 although it has changed a little. That is it.

If you look at trackitt.com where many people have entered their data to add to the statistics and you enter Buffalo and only look at after June 26, 2010 applications, you will find out of 84 applications, only 4 have been approved so far, one of them after only 6-7 months waiting time, the other 3 after 13-15 months wait. Some applications have been denied or withdrawn but out of the 78 applications still pending, 55 are already waiting more than 12 months.

If you want to compare that way then look at other visa offices like New Delhi, London, Singapore etc. Every day we hear on this forum that some post june applicant got visa. There are numerous examples. If your logic is true then the same would apply to post july 2011 applicants (MI-3) too which I beg to disagree with you.

MI-1 and MI-2 are totally different and different set of rules apply. You can't compare them.

I tell you more not a single post june applicant got the following email from a visa office. Only pre june applicants are getting email like that.

This is the reply from London VO:

Since you applied as a Federal Skilled Worker on or after February 27, 2008 and before June 26, 2010 , your application will take two years or more to be processed. This is due to the fact that Canada received over 425,000 applications under this program during this period. However, If you wish to withdraw your application, you may be eligible for a refund of your processing fees.
* Unfortunately, it will take longer to process federal skilled worker applications submitted under the first set of instructions (between February 27, 2008 and June 25, 2010) than originally projected.
* During this time, the department received applications for more than 425,000 people, and 144,000 of these have not yet received a decision.
* This number represents more than twice the number of projected admissions under the federal skilled worker program in 2011, so many of these applicants will have to wait two years or more to be processed.




I would say post june applicants are processed much faster than pre june and average time is 1 year at maximum. If some one orders CAIPS it can also be seen from bring forward date. It is rare that some post june applicant is getting delayed for so long.

Ask your wife to find MP of her local constituency then either write to him or personally meet if she can. Thanks

Because ministerial instructions were changed and new set of rules applied after 26/6/2010 and the instructions were to process post june applicants first and they only needed 29 occupations and not 38 doesn't matter if the change was little or bigger.

Maybe you are right and MI-2 will be faster but they haven't posted a timeline yet so it is too soon to tell.

I checked Buffalo because OP said he applied through Buffalo. Timeline in ND or anywhere else is not relevant to him. Further, just because you hear a lot of people say they got their visa after 1 year doesn't mean everybody does.

Thank you sir for your valuable thoughts. I still urge him to go to MP because there is no harm in doing that. He won't loose anything doing that.
