Hi Everyone,

Am struck in a unique case and i need your valuable suggestion to move ahead.

My husband traveled to Canada(Toronto) from his company on march 3rd on W1 worker Visa.
His VISA and work permit both are valid till October 2014.
His stamping was happened in 2012 October with 2 year validity so he happened to travel using same VISA.
his work assignment is for 2 years so 100% it will get extended.

My question comes here.

1. He being a skilled worker and having a VISA valid for more than 6 months( those were the 2 conditions which i saw in Canadian government website), can i apply here for open work permit and join him or should i travel as a visitor?

2. His company has given me a package as a visitor (Form IMM5257E) and they are not ready to process my VISA. They say they have some policy that dependents shouldn't work. can i process my VISA ( as a worker using form IMM1295E) on my own outside his company? is it is possible to do that way?How long it might take to get VISA if i start processing now?

Please suggest me which is better for me? travelling as a visitor or worker?

Hi

1. Yes, if his position is NOC A, B or 0, you can apply for an Open Work Permit based on his status.

2. You can most definitely apply for an OWP without any involvement from his company. They don't even have to know that you've applied for it. How long it will take depends on what visa office you will be applying through. http://www.cic.gc.ca/english/information/times/temp/workers.asp
