my problem....

married for 6 years, both children are dual citizens of the philippines and canada. my wife has been to canada many times on a tourist visa and now on a multiple tourist visa. we have had many problems over the last year. She came to canada with one of our daughters to spend the summer here. Well, problems became worse and in the last month she started seeing someone else and in the last 2 weeks moved out with my daughter! It was a horrific experience for my daughter and for me. My wife and daughter did finally go back to the philippines but here is where it really gets problematic....
!) still has a multiple visa until dec 2015 ..... what can I do now? can I get it cancelled or what?
2) this new man is feeding her with all sorts of ways to make problems when there wasn't any just for her to come back to canada and be with him.... like spousal abuse, physically and emotional and, they tried using that against me in order for me to fill out her new family class immigration papers,, she even stated she wanted me to lie and say we are still married and to finish the spousal sponsorship prior to her going back last week! I have that in sms and much more!
3) even though I have been supporting her family, siblings and our two children very well forr the last 6 years... she is claiming that I must still send that same amount as it is what I would have to pay in canada anyways! for 2 children.! is that true... is there reciprocal arrangements with canada and the phiippines. in the philippines 30k pesos could feed a small village every month! is it binding. she also states if I don't pay, which I will pay what I am directed to by law in the philippines and whenever it will be when she comes back to canada with our children
4) we have 2 property but only in here name....she says too bad so sad but thats for her new life and nothing to do with anything!

Its getting ugly.... and I don't know why! I have always fulfilled my financial responsibility and very hard working.

besides getting a lawyer here and there... can anyone guide me on all that I have asked??

I am just so LOSTnow!!

1) No - you can't cancel her multiple entry visa.
2) Don't sponsor her - it would be fraud if you are no longer in a real relationship. Also keep in mind that if you sponsor her, you will be responsible for supporting her for three years after she becomes a PR. This means that if she goes on welfare during this time, you will be responsible for paying this money back to Canada. This can amount to many tens of thousands of dollars. Keep all of the SMS and any other communications where she is asking you to lie for her. You may need these later.
3) & 4) These questions would be better answered by a family lawyer.

I appreciate your reply, and thanks for doing your best to answer me!
Questions 3 and 4 were meant for anyone knowing philippine law and possible reciprocity ...

Since you stated that I cannot cancel her multiple visa, when I am reporting that we are no longer in a relationship and all my financials were included in that multiple visa. Will she be allowed to return on her own to Canada even though that multiple visa was meant for visiting me in Canada. There has to be recourse on this matter....
I am NOT going to sponsor her since you are right that it will be fraud... however she has hooked up with another man feeding her all sorts of lines and lies. I have it on record she is only with him now so he can soon sponsor her...lol and also she wanted me to lie on her sponsorship. She wants to come back to canada edsperately!!!! By whatever means she has at her disposal....
HOWEVER... another twist to this story is that this other man has already sponsored his wife from the philippines, might still be under obligation or soon to end but is currently separated!. He now wants to sponsor my wife and, if he can't do that in a timely fashion, he will possibly bring her back quickly on the multiple visa which is still valid and that I initiated! Is this allowed?

You can't cancel the multiple entry visa. It doesn't matter that it was issued based on your financials. Now that it's been approved and issued, it is hers to use.

Probably time for you to take the lead in this and file for divorce on the grounds of adultery in Canada. That way you can ensure that your marital property rights are protected under Canadian law. Then, it really doesn't matter how she threatens you, it's all out in the open. Show your divorce lawyer the messages from her that are inciting you to commit immigration fraud.

ok.... I understand her multiple visa cannot be cancelled.

besides my lawyer.... doesn't immigration care about this scenario that she is inciting me to commit immigration fraud as well as she sent many several sms that she is with this guy for the sole purpose of him somehow sponsoring her so she can come back to canada?
if she comes back to canada on the TRV that was issued and she is asked questions at the border on her purpose of coming to canada... isn't it all on their system the particulars of the visa, our marriage and so on..... if she answer she is coming to see me and staying with me...wont that be fraud as well? am I splitting hair here?

we were married in the philippines and presented the documentation to the embassy in manila for the purpose of making our children dual citizens.... I believe any proceedings will have to be done in the philippines? does anyone know?

last question..... if she comes back to canada on her multiple visa which I am sure she will, can she then apply to be sponsored by another man?

thanks everyone.....

I'll answer the questions I can...

1) Yes - she can certainly come to Canada on her existing multiple entry visa and be sponsored by another man. It doesn't mean this sponsorship process will be easy since she will have to demonstrate that her relationship with you has ended and that her relationship with her new partner is genuine. But there is nothing stopping her from being sponsored.

2) It's always possible someone could be turned away at the border even with a multiple entry visa. However it's unlikely the questioning will go to the level of detail you have indicated and I don't believe all of the particulars of the visa are in the system (e.g. they won't know that you provided a bank statement to support the visa approval - although they may be able to see that she is married to you).

3) If you want to report her for immigration fraud now you can do so here: http://www.cic.gc.ca/english/information/protection/fraud/report.asp
