Hello ,

My PGWP expired on August 01. Now I applied to restore my status , but my question is if I am denied restoration of my status and renewal of work permit, will this be considered an overstay on my behalf? Keeping in mind I am already implied status because I am in the 90 day waiting period. If I do not hear from CIC , I will be leaving Canada. Please tell me if this will be an overstay if I am denied.

If I am denied and 90 days have passed, that is a definete overstay I believe?

You don't have implied stauts if you are going through restoration. You are in Canada without status. If your restoration is refused, no this won't be considered as an over stay.

Hopefully you have stopped working. If not you need to stop now since working during restoration is illegal. If you continue to work, this will be a problem.

Thanks for your reply. Yes I stopped working as soon as my PGWP expired. My restoration has been refused and my 90 days will be up very soon. Now my question to you is:
a). If before the 90 days, can I find another employer with a pre approved LMO and try to renew/extend my WP?
b). If the answer is yes, then If 90 days are passed and request is rejected WILL THAT BE CONSIDERED AN OVERSTAY?

i am trying my best not to overstay and leave the country before 90 days. what would be your suggestion?
