Hello everyone,

A family member of mine asked me for help.

Situation: He has met someone and wants to look at sponsoring his partner to Canada when he returns. He is currently volunteering in a SE Asian country that does not recognize gay marriage.

His relationship has been almost 1 year and he plans to stay for another year.

Should he look at applying family class Common-Law, conjugal partner? I also saw a post about possibly applying refugee status under LGBTQ reasons?

He is not in a rush but would like to know what class would be the proper class and have the greatest chance for success?

What steps should he take to help prove a relationship in a country that doesn't recognize it?

His partner would have a hard time getting a visa to a country that recognizes gay marrage.

NOTE *** He is educated, no criminal record and has some finances and a job when he returns. I am not concerned he won't qualify as a sponsor.

In order to qualify for conjugal, there would have to be legal barriers to getting married in the partner's country (this seems to be so), but also immigration barriers to him going to Canada and getting married/becoming common law there. In order to prove the latter, the partner needs to actually apply for a visitor visa to Canada and get denied. If the visa is approved, no chance of conjugal as he can come to Canada and get married or become common law.

In order to qualify for common law, they need to live together for a year and be able to prove it through rental agreements, utilities, etc (they need proof of cohabitation covering at least 12 months).

And of course, if he can get to Canada or some other country that recognizes same sex marriage, they can get married and then do a spousal application.
