Same grandfather. Relative ?

I have a quick simple question
The person is my uncle's son.. i could prove this through the family tree that we share the same grandfather and he is a citizen and currently living in Canada since the last 10 years or so
Will he count as my relative ?

Question 2. If he doesnt count as my relative, would it still help my case showing him on record ?
