Dear All,

I do apologize if I posted in wrong place. Could you please kindly suggest me on this.

I lived in Canada as PR for 3 years and 10 months, only about 20-25 days vacation to US. I got married with US citizen and moved to US just before I was called to write the exam. I got RQ on early Nov at Glen Erin and sent all the documents on Dec 16, 2013. My PR card is valid till Jan 2015. I am going to send the application to renew it around April or May 2014. Can I allowed to send the application letter from US? I will give the address in Canada to mail it back.

Many people told me that I should not be outside of Canada more than 6 months and I should go back atleast for a few days to maintain my PR and OHIP. Is it correct? Or just only to maintain OHIP as it will not be used if we live outside of Canada more than 6 months. I am going to work in US soon. So, if I need to maintain my PR status in Canada, I would like to go back within this Jan for about a week.

I also need to do Canadian tax for 2013. Can I contact H&R to do for me by providing all the documents that they need. I havent called yet or contact H&R in US for that but if you have any experiences, kindly share to me.

Thanking you in advance.

You can't "maintain" OHIP just by popping back into Canada for a few days every 6 months.
There is a minimum residency requirement, and that will not meet it. They are starting to get aggressive with residency fraud.

How about my Canadian PR status? For OHIP, I dont really mind if I lost it as I have health insurance in US. And to be fair, I dont live in Canada for a certain period of time. But I just dont want to lose my PR status for a certain years. Do I need to go back to Canada for every 6 months to maintain PR status?

At any point in time you must be able to count 730 days of physical presence inside Canada within the preceeding 1825 days or your PR status is at risk. If you have been a PR for less than 1825 days, you must not have been outside Canada for a total of more than 1095 days.

If you have lived less than 183 days in Canada for 2013 and do not have any Canadian sourced income (this includes interest from bank accounts), then I don't think you need to file taxes.

You still need to file Canadian tax if you have any "residential ties" to Canada, even if you haven't set foot in the country.
