RO for Minors

Hi,

What are the chances of PRTD approval of a minor kid (7 years) on H&C grounds for not meeting RO obligations. He has stayed in Canada for 670 days. Due to Air Travel restrictions during covid lockdown he was unable to come back to Canada and meanwhile the card expired. Both Parents have met RO requirements and got there PR cards renewed in Canada, now planning to travel to get the son back. If there is any chance of prtd being rejected, Is it better to apply for US visitor visa and do land border crossing once the borders are open. Any suggestions on this is appreciated.

Why has he stayed outside Canada and why couldn't he return? Permanent residents have always been allowed to come back to Canada despite COVID lockdowns.

With a recent breach of only a couple months and parents who normally reside in Canada, I would say the odds of PRTD approval are good, but each case is unique and officially there is no blanket exception made due to COVID.

In my opinion, the chances of your kid getting PRTD approved are very high. You both as parents already are established in Canada from what I understand, and kids are given a lot of leeway, since they cant make decisions on their own.

The earlier they apply for the PRTD the better.
