Risky Situation

Hi everyone,

My Wife and I started processing our spouse sponsorship application after we got married in Japan. Neither of us are Japanese citizens. We started processing at the Tokyo Embassy February 2010 . She has a student visa in Japan that expires next year.

Right now her school is asking us to pay within 2 weeks for this year. I was wondering what our options are because if we get approved in the next few weeks or months that would be a waste of money because we already planned on not completing the school and instead starting our lives in Canada. On the other hand if she doesn't pay and stops going to school she will most likely lose her student visa and we would have to transfer our case to her home country which im not even sure is possible without starting all over again.

So far we did the interview and sent additional documents.

Any advice/information would be greatly appreciated.

Can you pay for just one semester and then finish it even if she get the PR visa before that is done (if the visa doesnt expire before that is done) that way you can get the benefit of the semester and still be in status with the country?

Can you talk to the school officials, explain that you may be leaving soon, and see if you can pay for only part of the year, or month by month? Or is it possible in Japan to change schools and keep the same student visa? I'm sure there are some schools that would not insist on a full year's payment up front.

As i am also in japan and applying soon for immigration my wife is canadian.I think as your visa is valid since april 2011 then no problem for you. you can leave the school and enjoy urs time in japan .once visa is issued they can,t revoke it or cancell it and you already have visa till april 2011 so no worries.
just wait for ur PR.
Also can u please tell me how long its get to obtain police clearance certificate in japan?. Also please tell me which docoument u submit as proof of marriage Nepal Marriage certificate or japanese family register?.

Thanks for the advice everyone.

To answer Jiyamano's question it took us 2 weeks to get police certificate from japan and we had to get the police certificate from Nepal as well which took 3 weeks. We submitted our Japanese marriage certificate. You can also use a marriage certificate from your home country if its translated by a certified translator.

Yeah even if your on a student visa that does not expire till the end of April 2011. And you just finished up your courses i dont think they are going to revoke it. Does it state anywhere that once your courses were finished you have to leave or apply for another course?Im not sure about Japan Student Visas but i dont imagine they will say anything,once it expires then you will need to reapply or leave but your app will likely be done soon so i wouldnt sweat it.
