Risking PR Refusal to Avoid Wasting Job Offer Points

Hi everyone,

I applied for a closed work permit under LMIA exemption code C16 (Mobilité Francophone) on December 4. As I am not eligible for the Francophone EE stream (due to my French proficiency being at NCLC 5–6 rather than 7 across all skills), I was relying on the 50 points from my job offer to secure an ITA through Canadian Experience Class. However, the delay in processing my work permit application has left me uncertain about my eligibility timeline, since apparently job offers will no longer receive additional points starting March 2025.

I've noticed that answering "Yes" to the following EE profile questions grants me the 50 points (at least for the time being):
- "Is [candidate's name]'s job offer from the employer named on the current work permit?"
- "Has [candidate's name] been working full-time for the employer on their current work permit for at least one year?"

However, answering "yes" to the first question would be inaccurate, as my closed work permit is still processing, and my current permit is a PGWP. I've worked for this employer for over a year on my PGWP, so I'm not worried about the second question.

Considering the current processing time of 135 days and the fact that it’s been 50 days since my work permit application was submitted, it’s unlikely I’ll receive my new permit by March. As a result, I won’t have the opportunity to benefit from the job offer points if I simply sit and wait.

My current score is 478, which means with the 50 additional points, I would have received an ITA in today’s CEC draw. It’s frustrating to potentially waste such an opportunity simply because IRCC takes so long to process applications.

Given the situation, I’d like to understand the implications of deciding to answer “Yes” to the first question before my closed work permit is approved. Would I risk anything beyond having my PR application refused once? Could this lead to further consequences?

I’d greatly appreciate any guidance or advice on how best to proceed.
