Hi. Here are the facts: Feb. 2009 - came here to canada under TRV work permit
Dec 2011 - applied under FS Arranged employment
Oct 2013 - got pr approved along with my family
Nov 2013 - I finalized my pr by doing flag polling
April 2014 - family came
Here's my dilemma. My marriage broke down because of a 3rd party involved with my wife and I knew it like after 2 months of them being here and my own daughter told me that. She moved out with my kids. Can I still file a case against her to revoke her pr? Because I feel that she does not deserve the privilage of being a resident here given the fact what she did. She's not under the conditional pr since my application was recieved 2011 and we are married more than 2 years and have kids.
Can anyone help me find an immigration lawyer to clear this things and some info..

thanks

No you can not file a case to revoke her PR. Do not waste your time, money and energy on this.

I understand that you are suffering from the break-up of your marriage, but you must get it quite clear in your mind that immigration has nothing to do in the situation. Your (ex)wife is a PR in her own right with exactly the same rights, privileges and responsibilities as you.

What you more likely need is a lawyer or mediation service specializing in family law to advise on the next steps: separation/divorce, child custody & support, spousal support, division of assets etc.

I wish you luck, and hope that in time you will be able to put your sadness and anger behind you.

You cannot revoke your wife's PR status. You have no right to do so.

Even if your application had been submitted later - conditional PR still would not apply. Conditional PR only applies to people sponsored through the spousal family class. Since you migrated together as a family - it would never apply to you.

Move on with your life. Your wife is legally entitled to keep her PR status.
