Returning to Canada after 15years with Landing Papers (no PR card)

My family and I would like your professional services and advice to complete our Canadian Immigration.

We (my wife, son and myself) landed in Toronto in 2000. Our daughter was born in 2001 in Toronto (she has a valid Canadian Birth Certificate and Passport). In addition to our landing papers, we have the following cards:

Ontario Driver’s License, expired

Ontario Driver’s License, expired
The Scarborough Hospital

Unfortunately we had to leave Canada in 2002, to look after our extended family.

Since 2002 (to now) we had to take care of our extended family:
- my father in law was paralyzed, and eventually died of cancer in 2008
- my sister-in-law, died of cancer in 2012
-my ailing mother in law, is 67 and needs regular care and attention; she had an eye operation in March 2017, and is recovering
-but the most demanding of all is my grandmother, who is now about 97.

Now, as we are close to discharging our extended family obligations, we would seriously like to pursue our Canadian Immigration. Thus, we would like your professional advice and service. We only have the landing papers of 2000. We do not have the PR Card, nor have we fulfilled the residence requirement of number of days as we have been outside for about 15 years; nor did I (or my wife) work in a Canadian organization outside Canada.

What options to we have to resume our Canadian Immigration ?

If you want professional services, you'll need to contact the legal office that pays for the maintenance of this forum and be prepared to pay fees. All you're going to get on this forum is normal people like you giving advice.

You really have two options.

The first is to travel to the US and re-enter Canada via a land border via a private vehicle using your landing papers. If you are not reported for failing to meet the residency requirement, you can then live in Canada for two years straight and successfully renew your PR cards. If you are reported at the border, you'll need to appear at a hearing to argue why you should be allowed to keep your PR status. You do have H&C considerations, however since it's been 15 years since you've lived here (that's an extremely long time) - it's difficult for any of us to say how this hearing will work out for you. You may end up losing your PR status and being forced to leave Canada.

Alternatively, you can apply for a PR Travel Document from your home country under H&C (you'll need to provide evidence of your family's medical situations and will also want to demonstrate that there was no one else available to take care of these family members). If the TD is approved, you can fly to Canada and immediately apply to renew your PR cards. If it's refused, you can try appealing. If the appeal is also refused, you'll officially lose your PR status.

Having a Canadian citizen daughter doesn't make a difference in the process.

Whether you apply for PR TD or attempt to enter Canada via USA land border, you need to have evidence of all the medical situations of your family members. So for each case notes from doctors and specialists, hospital bills and records,. proof you were required to stay and there were no other family members to care for them, etc etc.

I also agree that trying to overcome 15 years outside Canada will be difficult to say the least. Time may simply be too long for IRCC to consider the H&C reasons. Of course the only opinion that matters is that of the person who'll be assessing your H&C claim.

Impossible to say. You'll have to wait until your passport has been returned to you.
