Returned Application - noting original application calculation

Hi,

I sent in my application Feb 25th, they received it Feb 28th (it was stamped). However it was sent back to me dated April 17th saying incomplete application - my photo is either missing or not following specifications - which is frustrating (I checked this met criteria and that it was included in the package 20 times - no idea what happened) but what can you do.

It only leaves me with a 21 day window (before the 90 days) I'm planning to send it in via Express Post tomorrow (Tuesday) and it should get there by Thursday.

However the letter also says:

Note: the date of signature on the original application will still be used for the physical presence calculations.​

1) Am I able to send the original application back as is with the new photo included?
2) Do I need to worry about the 90 day window - if they have included that note in the letter?
3) Or should I complete an entirely new application?
4) Do they count based on when they stamp having received the application OR when they actually review the application?

Any insight would be appreciated.

Normally, unless explicitly stated in the accompanying letter, an application that's returned as "incomplete" is treated as it was never sent. Therefore resubmission is as a brand new application, with all the requirements applicable at the time of submitting it.
