I have a very small concern regarding my express entry application.


I searched everywhere, I couldn't find the straight answer. My question is regarding EE applicant's obligation to return money to government who funded previous education while in Canada.

I came to Canada in 2009 and graduated in 2012. I left Canada as soon as i graduated. My tuition was covered throughout government agency. However, the agency doesn't promise any job or training after graduation. so when i returned back i had to find a job myself and I stayed unemployed for 3 years. Right now my job sucks, but it's better than nothing.

But In my scholarship contract, there's a line that says "a student shall return all the money spent should they decide to apply for another citizenship or live in another country permanently. Also, the citizenship and passport will be revoked as country's regulations prohibit dual citizenship". So I am not sure, what should I do in this case? I can't afford paying back my tuition, and at the same time, there is no job opportunity in my home country. .

More importantly, there is not any way my Gov. tracks individuals who applied for jobs outside, Canadian PR or US green cards whatsoever.

I know that my country's economy is just getting worse over time. I will have to struggle again with unemployment, poverty and unfair treatment.

Please help, I am seeking your sincere advice.
 
I forget to mention that - under normal circumstances- I am not required to return money even if got employed as it was not a loan. It is only when I seek another nationality that I require to return the money.


Will CIC be doubting and my application could be rejected on that grounds?
 
This isn't one that could be answered easily. What country are you from? Have you declared your loan in your application?
 
There is this quesion in EE application for:

4. Did XXXX XXXX study in Canada based on an award that required them to go back to their home country to apply their knowledge and skills? This includes some awards from Global Affairs Canada?
Select: Yes/No

Thanks kryt0n for taking the time and reading my posts. I am from Turkey originally.

No I haven't declared loans or debts in my EE application (although I still owe TD Canada Trust credit card some $2500 carried from 2012).

Well first it would be a good idea to clear the TD credit card.

1. I don't think so. My financial liability in Canada has nothing to do with my PR application. Credit Check is not done for PR applicants. If that is the case, then most PR applicants will be rejected, especially inland CEC.


2. Initially, I put "No". However, I'm still hesitate.

You may have to pay interest on those unpaid credit card dues. It will surely hurt your credit history once you get to Canada. It might be worth checking if you have the Canadian equivalent of a county court judgement though it wont affect your admissibility.

Well it sounds like the second one should be a yes.

As for the first, you are supposed to declare all credit cards. They may deduct this amount from your funds, but if you're CEC i guess it doesn't matter
 
The question doesn't ask if I owe my scholarship agency $$, it asks about whether applying skills and knowledge in home country was mandatory part of my scholarship.

Technically speaking, I should answer "No"...mainly because my scholarship contract didn't stress any "knowledge & skills application". However, from a holistic point of view, it might be judged differently.

If you have breached the terms of your scholarship, you have to fulfill the terms or return the money.
