Return immediately to Canada when granted Outland PR?

Hi all!

My fiancee is awaiting Outland PR approval from Argentina -- it will be about 9 months. There's a chance she will start a university course, and that I may go down temporarily to soak up the south american culture as we await the CIC's approval.

I am wondering what the flexibility is for returning to live full time to Canada once she gets her approval. I know they say you need to prove you are going to live in Canada - but I haven't seen any clear guidelines about how soon after approval is granted you need to move there.

Her visa will expire within a year of her last medical, or 6 months before the expiration of her passport, whichever comes first, so she must land by that time.

If she needs to return to Argentina to complete her studies, or wrap up affairs at home immediately post-landing, she can do so. Her residency obligation is 730 days out of every rolling 5 year period spent in Canada. Time spent abroad with you (provided you are a citizen) counts towards that obligation.

thank you! just to clarify:

- if her medical was done this July 2012, she would need to return to Canada before July of 2013
- she can return in July 2013, and then immediately return to Argentina, provided she spends 730 days of the next 5 years in Canada

Final question: if we are separated for any of this time, does ity affect her citizen ship? I may be staying back in canada for some of that time

2. It is a rolling 5 year period, not a static one. So at any point she returns to Canada as a PR, it is the 5 year period immediately prior to that return that is taken into consideration. So, in her first 5 years as a PR, it is OK if she is only present in Canada for 730 days or if she is accompanying you abroad for only that much time.

Any time spent apart does not count towards her PR obligation, and she should factor this into any plans to be abroad. Citizenship is different, citizenship requires 1,095 days actual physical residence in Canada out of the last 4 years. There is no exemption to the physical residence rule, all time spent abroad is deducted when calculating eligibility for citizenship.

1. Partially right. The visa will expire 1 year from the date of the medical or the expiry of the passport whichever comes first. It doesn't expire 6 months before the expiry of the passport.
