Restore work permit upon receiving OINP nomination

Hi guys,

My PGWP is expiring July 9th, 2016 and I will be submitting my OINP Human Capital Priorities Stream application package this week (hopefully by February 16). I know it takes a while for the whole process (to receive an AOR and eventually hopefully get the nomination). My questions are:

1. If my work permit expires and I receive a nomination sometime after July 9th, 2016, will I be eligible to apply to restore my work permit? This is of course, assuming that I will receive a nomination within the 90 days of my work permit expiration date. Is this something that is allowed by CIC? Is the nomination letter enough documentation to restore my status as a worker?

2. If I were to switch my worker status to a visitor status BEFORE the date that my work permit expires, will I be able to re-apply for a work permit when I receive the nomination letter?


Has anyone been in a similar situation and if so, what did you do?

Please help if you have any information or thoughts on this! Thank you very much.

Hi Butters1690,

1) Yes you can restore your WP status with the support letter that come along with your nomination certificate + Offer of employment which your employer have to do online (employers portal) and pay $230 compliance fee. Print the employment ID that you have to add to your WP application.
You can no more qualify for BOWP since your current WP would have expired before you apply also, you need AOR to apply for BOWP which you have not received.

2) I think so, but you can still gather more info about your question #2 but with visitor status in Canada you can apply for closed WP with the info stated above in 1

So, if I understood you correctly, with an AOR, I would be able to use it to extend my current work permit (before it expires)?
If I understand it correctly, AOR isn't a nomination. AOR is merely a acknowledgement of receipt of my application package, correct?

Is there any way at all my employer wouldn't have to be involved ... They are not very keen with forking out money for these purposes (I've already been denied an LMIA, so I am hesitant to ask for anything more)
