im in my 90 day grace period restoration. i already running 1 month as out of status ( due to finished contract ) i have a prospect of three companies all in food industry. as usual the long wait of LMO that was all filed in April 2012 have not yet gone out of its tunnel. my question is:

1. if and when the lmo will be issued and i will able to file my work permit and restoration before the very end of grace period; am i safe already of not a candidate for sending back home even if another waiting again will come up due to approval of restoration and working permit is ongoing and for sure it will surpass the last day of restoration period?

We are in the same situation and have 2 LMOs waiting that were applied for in May, and our 90 days expires 5 August. Here is what I know from speaking to a CIC Officer and from valuable information given by another sources.

You have 2 choices,

If within 14 days of your restoration period ending, you still have not received a positive LMO you can apply online to restore status and apply for the work visa, but you can only apply for one employer so you need to choose which one, as you said you have 3 companies. You need to send a copy of the confirmation from Service Canada and a job offer letter, they will then again hold the application for 2 months in which time you must send a positive LMO and you can remain in Canada until a decision of the visa is made.

The other option is to now apply for restoration as a visitor to regain status then once the LMO is approved you can then either apply to a visa office outside of Canada for a new work visa or if you do not require a mulitple entry visa you can go to the border and get apply to get your new work permit from there.

This is all very stressful and there are too many of us in this situation, I hope this helps as the only thing thats helping me is the advice and help offered by others. Its a bad bad situation.

i am wondering in this passage of yours as:

is there a violation if applying for many prospect gathered that the more it will not be approved by the CIC?...

the reason of applying all prospects is putting oneself on a safer side with a multiple chances of fallback. what i meant is we are facing a blank wall which prospect employers will ever pass or get a positive result. so it's really a kill if and when the chosen one fails...

I sent a question to an expert asking not only about possibly changing our status to visitors, just in case the LMO approval did not come back in time thus ensuring we have a status in Canada but I also asked the question regarding applying using 2 file numbers for on the application this is the reply.


"No, you cannot apply to restore status as both a worker and a visitor. It is one or the other. Secondly, if you apply to restore status and change your conditions from worker to visitor, there is no set amount of time to request".
"Finally, NO, you cannot apply for restoration showing 2 LMO File numbers. You must choose 1. A regular work permit is employer specific. There cannot be multiple employers listed on a regular work permit." I hope this helps a little.

So re reading the advice you may be able to apply on seperate applications for each possible employer that you have and when the first LMO is back you can call CIC to inform them of that and withdraw the other application that you have placed, I would really contact CIC and confirm if you can do multiple applications though.

Did your employer show recruitment efforts? Have you signed a contract with your prospective employer? Has an application for the LMO been filed in your name? How long ago was the LMO application sent? Considering the lengthy processing times of LMO it would help if you ask for your employer's help in following up the LMO application. If recruitment efforts had been shown and there were no CC/PRs who qualified and applied, and your application package is in order, IMHO, I don't think CIC would refuse you the WP/restoration considering you'd be an asset to your company and the Canadian labour market as well.

Also you should send your application for restoration on or before the end of 90 days. Don't wait too close; take into consideration delays with the mail/courier services.

thank you job_seeker, i have this appointment tom with the one of the 3 prospective employers I got. actually we have just do series of communication over the phone re status of LMO. My basic accomplishent for now is my resume e-mailed to them. after a wait of two months and my grace period status is already running half; I e-mailed them again what scaryclare advised me on pre-application of restoration and wp using applied LMO date with HRSDC no. telling my intention of just making use of the time hitting two birds of one stone. i just don't know if my meet up with my prospective employer is already buying my suggestion. prior to this I offered myself to be interviewed personally so this prospective employer and I will figure out whether am I considered or not. Tommorrow's meeting is my initial personal appearance and hopefully it will turn out to be fruitful and positive.
