Restoration process

Hi, i'm an international student whose study permit got rejected because the file I attached to my application with my scanned passport was damaged, they sent me a letter asking me for my passport again but by mistake I sent the same file and then got rejected. I got an e-mail a week later but couldn't open it, almost 4 weeks later I tried again (MY BIG MISTAKE) it was another letter asking to reapply but I had the bad luck I was able to open that document until my study permit was expired so I had to apply for a restoration, i've been waiting over a month now and when I called CIC last week they told me to wait until December 30th, meaning i'll miss my paid semester. Please give some advise of what can I do. Either way I want to leave the country december 14th and if I get my study permit apply in my home country for a new visa. Is that possible? Can I leave canada while on restoration process? Does it really take this long to process restoration? what will happen with paid semester?

When is the last day to withdraw your tuition fees at your college? You could withdraw or defer your payment to the next semester; however, you have to act fast. Go to your college's registrar's office and explain your situation, tell them you cannot study this semester because you lost your status and now have to wait for it to be restored. I can't believe you missed your chance to get a renewed Study Permit twice! If you decide to leave while your status is being restored you will have to apply for a new Study Permit at the visa office in your country, there is no guarantee that you will get it a second time. I recommend that you stay in Canada until your status is restored, you have to be patient because it's your fault that you let your Study Permit expire. Deal with your tuition fees in the meantime.

Your college fee shouldn't be wasted. Talk to program admin and seek deferral letter (drop a semester) But you must keep in mind the last date of withdrawal from the program which is usually 10 to 15 days from the program start date.

Now, if you leave the country while a decision is being made on your restoration, you would need to apply for everything from your home country as restoration is for the people who are in Canada and lost their status be it study or work.

Getting it done from within Canada is easy, so better to stay here while a decision is made. your case doesn't look difficult, hence you should better avoid making it complicated.

I already drop the semester, and called CIC and they told me I can leave canada because my restoration process can't be cancel is just that when I come back I need to have that permit in my hands, which is not a problem since my sister who lives in Canada can bring it to me back home. Is not my decision to make wether to not leave Canada, but I have to leave December 14th, hopefully I would get my permit before leaving i've seen cases that got their restoration before the four months so i'm praying that to be my case. :(

Did you really talk to CIC and this is what you were told? I doubt. As far as returning to your home country and re-entering Canada, you don't need study or work permit in hand but a Valid TRV. Now, go to the search option and look for keyword "restoration", you should find a thread where a candidate's application got rejected (under restoration) as he left Canada. He was advised to apply from his home country.

Lets go by their exact words "You may seek restoration within 90 days after your status as a visitor, student or worker has been lost, because you failed to comply with one or more of the following conditions". Now doesn't it ring a bell that restoration is for a person who has lost his status in Canada be it work, study or tourism?

Anyway but then I have absolutely no plans to contradict what CIC agent has told you over the phone. My only suggestion is to reconfirm before you leave Canada.

And Restoration usually doesn't take that long, you should hear good news with a 30 to 45 days which is way ahead of 14th December.
