Restoration or new-entry? HELP please

Hi guys,

I applied for the work permit with LMIA, and I got a refusal letter and says it was rejected because I didn’t possess a valid LMIA. (when I got a refusal letter, LMIA was still in progress)

So now I’m out of status, I can apply to restore my status within nov 19.

I would like to stay in Canada with my boyfriend to apply common law.

But because of my status, I will leave Canada for now and will come back on Jan next year.

My question is...

1. Should I restore my status as vistor?
Or I just leave and come back on Jan?

2. If my restoration application is in progress, can I leave Canada?

3. If I don’t restore my status, and come back Canada on Jan, Can be risk?

1. Your choice.
2. If you leave Canada, the restoration application will be canceled.
3. Whether you are allowed back into Canada or not is always up to CBSA. If you leave immediately, the fact you didn't apply for restoration shouldn't be an issue.

Thank you for your replying.

My work permit was rejected on aug 19, and I got a approved LMIA letter sept 18.
So I was still waiting for LMIA from aug 19 to sept 18. And I was considering until now that apply to restore work permit (with LMIA) or vistior because I didn’t want to work the place I got LMIA.

So now I decided not to work, I am going to leave Canada very soon (I won’t apply for restoration).

After aug 19, it’s been already almost 2months.

When I’m come back as a visitor, could it be a problem that I was staying Canada for 2months out of status? (I won’t apply for restoration)
