Hello everyone !!

People often post on a discussion forum if that have a problem. Same problem pulled me to this forum. I am hoping you guys can clearify my problem.

My condition is also related to restoration of status in Canada. My wife and me came to Canada on 2010, My wife as a student and me as a dependent. Once we came here I changed my status to Worker (as a spouse of a student is allowed to work). Recently she completed her Masters degree and applied a "Post Graduate work permit". At the same time I also applied for the work permit extension but got rejected. The rule is I cannot get a work permit unless my wife get a Job in Canada that falls under NOC 0, A or B level. Currently she don't have job.

Now the condition is, my legal status ended on 18th March 2013 (that is few days ago). Now I have to restore my status or else should leave after 90 days.

Now my questions are:
1. Can I restore my status as Visitor? So that I could change it later on when my wife gets job.
2. I tried to apply online but it only shows $200 fee for restoration but do not charge $75 for Visitor application. In such case my application will be rejected if I don't pay $275 in total.
3. Can a work permit holder can restore his / her status to Visitor?
4. If I apply on paper it might take more than 90 days in total. Can I stay in Canada longer that what I am allowed in such case.

Hi,

1. Yes you an restore it to visitor.
2. There must be a option of restoration to a visitor because if you don't pay $275 , then bye bye.
3. Yes you can restore it to student or visitor or your previous status.
4. Yes, Because you will on implied status. And can stay until the result come. But you're not entitled to work in this time.

Why don't you get a LMO from a employer and apply for work permit?

Confirm that the spouse of a PGWP holder is eligible for an open work permit before you apply. As you wait, why not find an employer willing to apply for a LMO for you and if approved, apply for a work permit tied to that employer?

Guys
Just an update that I got my status Restored as visitor and now I already applied for Work permit. Should be able to receive within a week.
Restoring as a visitor just need to pay $200 for restoration. You do not need to pay $75 extra for visitor permit. As I paid $275 in total, CIC returned me $75.
So whoever having such problems. Just restore your application online as a visitor and just pay $200 as a restoration fee.
