Restoration of status questions

So I applied to extend my visitor record in November 2014, I was still in status then though that elapsed in December, I know I then went over to implied status until.....

Yesterday I got the message saying my application has been refused. I know there is a 90 day grace period to apply for restoration, does this period start from the date of my refusal, or from when my last VR expired (Dec 1st)?

On their website it says:

Requirement details

90 Days

Clients who have been refused an extension to their temporary resident status, and were in status (including implied status) until the refusal, have 90 days from the date of the refusal notice to apply for a restoration, if otherwise eligible.

Clients who submit an application to renew their status after it has expired, but within the 90-day restoration period, will receive a notice from CPC Vegreville warning them to apply for restoration. Clients will have 90 days from the date their status expired to submit their restoration application and corresponding fee.
Now I was in implied status until yesterday so I assume the bold applies? Though the last thing I want is the risk of the border patrol knocking on the door I assume it wont happen in the 90day grace period!

Any input appreciated.

It is quite clear on their website.....

Ok thanks, I know I don't want to sound like a dummy just a bit worried as I want to make sure I stay within their rules, I wasn't 100% clear with what they said in the refusal letter but read the stuff on the website after.

I haven't decided yet if I will apply for restoration as if Ive got 90 days from yesterday this would take me through to fairly close to when I was hoping to stay too anyways, and leave before the 90 days is up though would be bending the rules? . How long is the process for restoration anyway same as current guideline times for a VR. I mean if I apply today and it was turned down again in a month or so I will have to leave then.

If you ever plan to come back to Canada then I suggest you don't try to outsmart the system. Usually a couple of weeks is more than enough that what you need to leave when a refusal is recieved. If you feel it will take around a month to leave then I would suggest to apply for restoration. If it is accepted or not is not something you care about, you care about following the rules and not abusing them. If you ever try to come back you will have a genuine reason to be without status for that one month period.

It is not about "bending rules" it is about respecting the spirit of the rule. If the CBSA officer feels you abused the rules, even though you didn't violate them, then you will have trouble in your next entry.

Thanks for the advice, of course I wouldnt want to cause myself problems down the line. Applying to restore is the same application form as before? Do you get implied status back once a restoration application is put in?

No. Implied status only apply for people that submitted an application while in a valid status. At this moment you are without status.
