In 2004, three of us, Me, my husband and my son (son was 2 years old in 2004, now he is 17 -still a minor)moved to Canada, did the landing process, got our PR card and returned to india within 2 months. We never returned to Canada after that. We obviously dont meet the residency requirements. We have not renounced or cancelled the PR. What are our options if we would like to get our PR status back, or if we can get it back for our child who is still a minor.
Can we go for tribunal hearing? Can we apply under H&C?

Also, Can our child come to Canada on a study permit.

Your son can attempt to keep his PR at 18. You and your wife don’t have grounds to keep your PR Although you can certainly try. You can enter through US land border if you have a US visitor visa and hope you don’t get reported and then remain in Canada for 2 years. You may not have access to healthcare and will only be able to work if you have your SIN. Your chances of being reported are pretty high so it would be a big risk to leave a job and pack up your life just in case you don’t get reported. You son has a better chance.
