Hello,

Question 1: I landed in Canada (Toronto) in April 2009 and my PR card will expire in April 2014. I currently live and work in the U.S and I am making an arrangement with my organization to allow me to live and telecommute from Canada to the U.S. If it works, I will be able to live in Toronto starting late June 2012 but I will have to travel to the U.S., approximately 5-7 days out of a month and also I may occasionally go on holiday outside Canada. This means when it comes to the expiry date April 2014, I will have actual physical presence days less than 730 days. How can I make sure that my PR card will not be revoked as a result?

Question 2: Futhermore, my organziation is the World Bank and Canada is the 7th largest sharholder of the Bank. Hence, will my employment with the Bank could be counted into the residency day obligation.

So that you know, I am serious about maintaining my PR status in Canada and therefore, I have been making an arrangment. However, it takes me a while to finalize this arranagment until now. Thanks, appreciate for your guidance.

Answer to question 2: No, this doesn't work.

Answer to question 1: Continue to live in Canada but don't renew your PR card until you accumulate 730 days in a 5 year period.

Agreed. You will have a problem when your PR card expires because if you apply before you have 730 days, it will most likely go to a Residency Questionaire and will take another year to process and no guarantee it will even be renewed. During which time you would not be able to travel.

At the time of your PR expiry, you can make a choice of the job or the PR. Either move back to the US, lose the PR and keep the job or quit the job and stay in Canada with your expired PR card until you have 730 days and then apply to renew.

Thanks both for your advice. Just so that I am clear, at the time of PR card expiry April 2014, say I have only 600 days in total. This means, i should not renew my card yet nor travel outside of Canada. Instead, I stay put additional 130 days inside Canada before i start the renewal process so that I have 730 days over "5 year 130 days" period? Is my understanding correct ?

If it is correct, will I be considered illegal right after my PR card expires?

Thanks, Dawkmaai.

The first paragraph is correct.

No - you won't be considered illegal as soon as your PR card expires.

You are not illegal in Canada after your PR card expires but the 5 year period you must have 730 days in is a moving window of exactly 5 years. When you apply to renew your PR card, they will look at the 5 year window before you applied. Say you apply on Dec. 1 2014, they will look at the period of Dec. 1 2009 until Dec. 1 2014 and in this period you must have 730 days.
