Hello folks,

I applied outland via the London, UK office for a Family Class visa, Common Law partner, with my girlfriend as sponsor.

I've lived in Canada for over a year now, however I've lived at her house. As such I didn't pay any rent and the mortgage is entirely in her name.

I sent my application off in August and couple of days ago I received an email from CIC in Missauga that I need to send the following documents:

This refers to your application for permanent residence in Canada. In order for us to continue processing your application, please submit the following document(s):

> Proof of Relationship (Cohabitation): Please provide proof of cohabitation (leases, rental agreements, etc). This must be received at this office by: 2014/10/05
As you can imagine, I don't have any such proof - neither a lease nor a rental agreement. However, I sent them plenty of proof that this is my main address with countless letters from banks in my name coming to our shared Canadian address over the last year, along with our joint bank account, being named beneficiary on her life insurance, my own health insurance etc., etc

I'm not sure what to do. They say that if i don't send the documents by the given date my application will proceed without it. So perhaps I can tell them to process it without such proof due to my situation?

Anyone have any suggestions as to what to do?

Hi Kuz,

Sent them an explanation from your partner that you lived in her hues for the entire duration of your relationship (minimum of 1 year cohabitation) so, put the time that you lived together till the present.

Statutory delxlaration from the parents of your partner stating that you live in the address for the entire duration if your stay in Canada.

Send them an explanation that you cannot provide them a lease agreement/ rental agreement. Provide them some correspondence like letters with your the same address together. Canada Revenue Agency changed from Single to Common-Law that was filed recently. It is a solid proof that you are indeed Common-Law.

Also, if you can send some documents from the government with your the same address together.

You as one of the beneficiary in any insurances. Also Cohabitation agreement would be a great idea since your partner own the house.

Thanks sooo much for your reply.

A statutory declaration from my parnter is no problem. We already sent them statutory declarations from both her parents that we've been cohabiting in a cojugal relationship that is exclusive for over a year.

I had lots of letters come to me from banks to our shared address, which i sent. I'm named as beneficiary on her life insurance which has my address at our shared house. I have nothing from the government, except the letter from CIC extending my visa as a temporary resident ,which has my address on.

We could also create a cohabitation agreement - but i don't think we can backdate it. How would such an agreement look?

Make sure you also note to them that since this is her purchased home, there is not a rental nor lease agreement and you are unable to be 'added' to her mortgage. You could likely also file the 'stautory declaration of common law' with CiC to see if that helps them as well. I think the form is IMM5409e?

Hi,

Cohabitation Agreement, it is just an agreement about you and your partner, how you will divide the estate and assets when there is uncertainties that will happen in the future. There is no back date whatsoever. ( you can search about it online, I made mine through online set-up. It's free, you just have to look for the right website. Search it in google.

Just sent them a letter telling there is no way you can send lease agreement. Send them some important documents showing that you are indeed Common-Law like filing as Common-Law for the tax year of 2013, and send them again the StatutoRy Declaration from your partner and also her parents.

Government ID's like Drivers license of your partner showing the same address.

Dammit! How did i miss this during my application process??? This would probably have avoided their email. However, It says that I need to get it signed by the Commissioner of Oaths - how can I get that done? Especially in the next 25 days.

Anyone any ideas?

Isn't that the same as a notary? I am not positive about that, but I thought it was. If it is, then most lawyers have that ability, at least where I live, they do.
