hi,

my history is: i,wife and daughter (12 years) landed at toronto on 27th march 2011 and came back to home country on 27th april 2011 mean stayed only 31 days.Our PR card expires on 7th may 2016. as per PR card we have only 725 days and as per landing date we have only 684 days. i know about being reported and then file appeal before immigration appeal division.

my confusion: what should i do? land with family or alone to avoid high expenses? please share your experiences.

CBSA will let them in as they are still permanent residents, but they can make a report to CIC (not obligatory) that they didn't meet residence obligations.

Incorrect.

As long as their PR cards are valid they will be allowed to enter Canada and won't be refused entry.

Dont worry, they'll let you in and wont do anything. CBSA is all talk and no action. They'll just give you a warning and make it seem all serious, but dont worry, just listen to them dont say anything and they'll let you pass. Keep us posted with the good news once you are in Canada

Country where he is coming from Canadian immigration officer check all passengers documents very carefully and inquire before flying. If he pulled them then he flag them and they have to apply for return permit to come back.

Hi Gogia what the heck are you talking about ???please keep your advices to yourself if you are not sure about your immigration informations,for god sake please stop confusing people seeking help in this great forum.

Hi chetankumar,
you will for sure be allowed into canada because you are a permanent resident and your PR card is still valid,no one can deny you entry.
depends on your luck and the officer you will encounter at the POF you maybe reported by the CBSA agency if so you will have to file an appeal then and wait it out.
if you are not reported then you will just have to stay in canada for 2 years without leaving the country to meet the residency requirements and once meet you can apply for a renewal of your PR card so you can leave canada and reenter without hassle.
please keep in mind that the 2 out 5 years residency requirement to maintain your permanent residence status in canada is based on the day you have landed and not the day in which your PR card was issued.
i would advice that you travel together with your daughter and all your family members that hold a PR status since traveling separately will increase the chances of one of you might get reported at the POF.
finally i think based on my own opinion that as of now you are not falling behind the residency requirement badly so they might not report you but you should travel ASAP,the longer you are staying outside canada the harder its getting for you.

And if he has a valid PR card, how are they going to know (or care) if he has met the RO or not

My friends mother stayed outside Canada consecutively over 3 years last year 2012 she try to flew from India immigration officer pulled her ask few question after he refer her to Canadian consulate to get return permit, when she apply return permit they denied they said. Appeal in Canada, now she appeal in Canada waiting for hearing she is still in India her lawyer made a appeal in Canada, they said they will do 3 way call to India once hearing date comes.,

Because people like Encanto and Canadavisa13 who just post what ever they thing is not correct, and giving people wrong advise, facts r facts, if they pass through immigration with out problem, they will be lucky, immigration officer has lots discretion and powers, plus they can flag any one they feel did not meet residency , or has no intention to prove live in Canada, now a days it's not easy what u thinking!!!!!

Immigration officer will ask few questions after that he will decide if he let them in, why they stay outside Canada what was reason, if they prove immigration officer at airport either at boarding time or at entry at Canadian airport, can flag them, or might they let them in, chances r 50/50,

RECENTLY my friends brother try to fly out from Abu Dhabi airport to come back to Canada after over 2 years stay in UAE Immigration officer pulled him out for interview for a such a long time since he got PR card, he said he is working in UAE

Immigration officer interview Him, And was not satisfied with his interview, refer him to consulate, they revoke his PR card, because his intention was not to settle in Canada, now he did appeal through lawyer, to grant him PR again on HNC basis,
But I don't think they will, PR card is just authorize u can work in Canada as long as u abide rules and laws of Canada, and purpose u gain PR card,

This isn't possible, if your friend's brother had been out of the country for less than three years -- as long as they don't hit three years, they can still meet the RO. Intent to settle has nothing to do in that case.

If he had been out of Canada for less than 3 years, he would still have the possibility to meet his RO requirement; so he did nothing wrong

Also, why woud the UAE immigration Officer question him about his Canadian Immigration?

Why the **** do people go through all the trouble and torment in getting a PR if they wan't to spend more than 3 years away from the country? Beats me.

Dealing with immigration officers is a skill and I guess not everyone possesses it. The first rule is to always be confident about yourself, and to know the answers well ahead!

Thats cause

1) Getting a job for an educated professional is soo bloody hard that people are better off working in their own country
2) Cost of living is soo expensive (car insurance, cell phone, taxes, grocery)
3) Cost of transportation is very expensive and the subway dosent cover the entire GTA, people have to wait for buses which adds time to their already busy schedules.
4) Cost of car and home insurance is extremely high and when you call for an explanation they tell you its cause other people in your area are getting into accidents or some other dumb reason
5) Stupid service and regulatory fees slapped in practically every service you want to buy
6) High prices, high taxes, low wages.
7) Bureaucracy and red tape
8 ) Lack of high quality and high powered jobs


Bottom line is its pretty much a government regulated scam of legally stealing from the mass public. And this is one of the big reasons why people come here, only stay to get the Canadian passport and take off ASAP because their lives are much worth living outside Canada with a Canadian passport than living in Canada as a Canadian citizen.

Dealing with immigration officer is a cake walk cause most of them are high school graduates, they've just gone through a government regulated training program. All you have to do is communicate with them clearly and only answer the question they ask. Thats all.
