Hi folks, I would appreciate if you could kindly provide some guidance on the following from your knowledge and experiences

Background **
  • Landed: ma 2014; Departed Canada 2 weeks after landing
  • Returned to Canada: ma 2017 (cutting it close...:confused:)
  • RO:
I must stay on in Canada in order not to breach RO.
However, I will start working in the US from ma 2018 (on H1B) and will normally not fulfil RO. I plan to travel back to Canada every other weekend as my spouse (a dependant on my PR application) will remain in Canada.

I would like to avoid any drama of being reported in breach of RO at PoE and losing PR that way (and the shadow that could cast on a subsequent PR application)​

Questions **
  1. Can you highlight any weaknesses in the following plan: renounce PR, get TRV (so I can visit Canada) and re-apply for PR via spouse sponsorship?
  2. Can I renounce PR and apply for TRV at the same time?
  3. Can my spouse sponsor me immediately, or is there any requirement that a sponsor must have held PR for 5 years prior?
  4. Are there any other options I should be considering?

Others can comment but not sure a plan to apply for a TRV and expect to guarantee to enter Canada every other weekend on a TRV as a visitor will necessarily work.

Once you renounce your PR status you of course lose your right to enter the country and will be assessed same as any other visitor given you will have no work or study permit to back up the TRV. Coming in for extended visits is one thing but regular in and out completely different,as said others can comment as well.

I would suggest to Renounce your PR and get TRV. You yourself mentioned that you will not be complying with RO, you don't want to piss-off CIC/ IRCC and end up making it hard for yourself to get a TRV, so you better end your relation with them in good terms. Seems like you want to live in Canada but work in US, unfortunately that is not why you were granted PR at first place. Perhaps, you should put effort in getting a green card in US.

Oh, I do want to live AND work in Canada. It is just that after 1 year of searching with no joy, I choose this option to move..

Unfortunately if you decided to work in another country and your family remains in Canada there may be consequences.

Like to remind people that their family world income must be declared if their spouse and children are in Canada. International workers seem to often forget that little detail:)
