Rejection - Please Help Seniors

Dear Members,

Please help me out, i had recently got rejection under FSW NOC 1231(bookkeeper). On june 22nd 2010, they updated my status with DECISION MADE. And just today i got rejection letter stating that we have closed your file for the following reasons. But the rejection points are simple. The reasons were -

- That your experience letter was exact copy of NOC Code 1231 regarding your duties.
- You havent attached business card of your employer with your file.
- Your salary was not mentioned in your experience letter.

Please guide me is there any chance for this, the points are simple. The visa officer might had asked for document request for my experience letter and business card, but straight away the visa officer rejected my file.

Now the point is that is there any case for appeal, or should i contact CHC Delhi with updated documents or should i go for Federal court in canada. What are the chances.

Please suggest me what should i do, i have my AEO with me as well.

Sorry to know about your status? Can you please let me know which is your visa office? At what stage they reject your application? After medical and passport request or after submission of full docs or after submitting initial file to CIO?

Sorry to hear this news.Did you send your payslips with the documents? If your salary is not mentioned on the experience letter but according to your payslips CHC can get a plethora of information.please reply.

You can send remaining documents with a request letter to reconsider your case.

Sorry for the bad news.

A request letter along with the missing documents can be sent but not sure if that will work or not. Technically they might not open the case again since the documents were missing. It is up to the visa officer to take a decision without documents or request documents, so appeal also might not work

Hey, sorry to hear that mine also got rejected last week Ecas showing Decision Made god Know's if its error from the system or negitive sign
for my application cus still i did not got any letter from CHC, if its rejected only becus of my file was pending 120 days are over, my application was pending cus i could not get 67 points with my IELTS my overall was 8 but with AEO 71 but the problem is my AEO sent to HRSDC 15th of Feb,2010 still not approved no news from service canada VO was waiting the positive AEO, But my file was in process after all rejected...

I am so sorry to read about your situation.
I am not sure if there is anything can be done at this point.
However, others can learn from it. Let's look at it in details:
- That your experience letter was exact copy of NOC Code 1231 regarding your duties.
it is mentioned in OP6 on page 21 - Descriptions of duties taken verbatim from the NOC should be regarded as self-serving. Presented with such documents, visa officers may question whether they accurately describe an applicant’s experience. A document that lacks sufficient detail to permit eventual verification and a credible description of the applicant’s experience is unlikely to satisfy an officer of an applicant’s eligibility.
- You haven't attached business card of your employer with your file.
It is not a big deal, because it is not obligatory for someone to have a business card, but, it comes under the aforementioned citation from OP6, particularly the latter part.
- Your salary was not mentioned in your experience letter.
If you did not provide any other documents supporting that you were paid for the job you did, you could sufficiently prove that you had been PAID, and it was NOT a volunteer job or unpaid internship which both CANNOT be counted towards FSW.

*verbatim means copy, word by word.
*self-serving here means maid-up, not exactly real, something "cooked" to "cater" your application .

@ash_1967 - My visa office was CHC Delhi, File was approved from Sydney, Nova Scotia under AEO.

The timeline was like this:-

We received your application for permanent residence on January 28, 2010.

We reviewed your application and sent you a letter on March 15, 2010. Please consider delays in mail delivery before contacting us.

Your application and supporting documents were received by the New Delhi office. They are pending review.

We transferred your application to the New Delhi office on March 24, 2010. The New Delhi office may contact you.

Your application was reviewed and we started processing on June 22, 2010.

A decision has been made on your application. The office will contact you concerning this decision.

The rejection was before medical request.

@staralihaider - there was no such verification call from CHC Delhi at my employer place and nor any physical enquiry.

@manir - there is nothing written on rejection letter for any further document request or any appeal or any timeline for further requests.
