- That your experience letter was exact copy of NOC Code 1231 regarding your duties.

>>>> So many times seniors like qorax had been mentioning that the job duties should not be cut paste from hrsdc website. This is a big problem for you , Visa Officers dont like it.

- You havent attached business card of your employer with your file.
>>>>> Now, you can send your employers business card and request for recondideration and do send one more letter from your employer mentioning the last drawn salary.

You can send remaining documents with a request letter to reconsider your case.

@explorer101 - that was the big problem, actually i had send all my documents to my cousin in canada , he did all my file preparation, i had send my employer letter head to him with duly stamped and sign. He found Canadian employer for me and processed my file for AEO in canada itself and preapared the file with required document and couriered it to CHC Delhi through canada post.

Like u said that i should send my employer business card , a letter from employer mentioning salary......that wont be a problem for me, but what should i write in my cover letter as they had closed my file as per written in the rejection letter.....HELP?

Sorry for the bad news.

A request letter along with the missing documents can be sent but not sure if that will work or not. Technically they might not open the case again since the documents were missing. It is up to the visa officer to take a decision without documents or request documents, so appeal also might not work

@rocky272727 - so what should i do , send documents or go for federal court (is there any chances in this or have u heard any case passed through federal court), i think all my time, pain and money has been wasted after this whole gruesome 13 month time.....well just praying god for any option to work out on this.

Dear Amritvirdi,
I am so sorry to read about your situation.
I am not sure if there is anything can be done at this point.
However, others can learn from it. Let's look at it in details:
- That your experience letter was exact copy of NOC Code 1231 regarding your duties.
it is mentioned in OP6 on page 21 - Descriptions of duties taken verbatim from the NOC should be regarded as self-serving. Presented with such documents, visa officers may question whether they accurately describe an applicant's experience. A document that lacks sufficient detail to permit eventual verification and a credible description of the applicant's experience is unlikely to satisfy an officer of an applicant's eligibility.
- You haven't attached business card of your employer with your file.
It is not a big deal, because it is not obligatory for someone to have a business card, but, it comes under the aforementioned citation from OP6, particularly the latter part.
- Your salary was not mentioned in your experience letter.
If you did not provide any other documents supporting that you were paid for the job you did, you could sufficiently prove that you had been PAID, and it was NOT a volunteer job or unpaid internship which both CANNOT be counted towards FSW.

*verbatim means copy, word by word.
*self-serving here means maid-up, not exactly real, something "cooked" to "cater" your application .

@slavasz - thats why we say "we learn from our mistakes" anyhow right now i am contacting some immigration lawyers in canada to know more about federal court and the chances , it i get something positive i will go for it ....what do you prefer seniors.....if i wont get anything positive i will wait for another one year and apply again, whichever rules are applicable at that moment.

What about my AEO will this help me in any case and on june 26 they had taken out accountants and finace category from the NEW NOC Lists.....donno when they are going to add my profession in this. Is there any way to get there?????

Dear Virdi,
I think you have already AEO, so you need not to fall any occupation list? So you just reapply and take exact experience certificate from the company you are working with? Federal court will take minimum one year time and will cost you much money too?

So apply fresh application with all the documents for which absence they make you reject and you will get through.

Hope this will help? Lets others views also?

Thanks

This is the time of strict processing by the IO and you made the mistakes.
I dont see there is much you can do, Canada Dont welcome people who lack minimum standards to make papers as per the visa guide. YOu took it lightly though you thought you didnt, in fact you did, and now the CIC took it strictly.

They get millions of applications and they are in dire straits to deal with files sent by more and more brilliant people from around the world. They have a deadline to decide on files and you made major mistakes, making them think that you needed more quality to qualify to be a PR.

Better luck next time !

amritvirdi , since you have AEO, you are pretty much insulated from the new rules that were introduced in June this year

You have two options either to approach the Fedral court ( time and money consuming process) or to apply again (may be less money consuming). Ofcourse there are chances of success are not 100% in any case for any one for that matter but no harm trying
