Rejection Please Help, Advice.

Hello seniors !
Please Reply to my topic, as soon as possible as i need to take decision Please.

I got email saying its rejection due to the following point.


No points were assigned for a relative in Canada as sufficient documentation was not on file to satisfy me of the relationship with Kalpanaben Priyawadan (Official documentation indicating the name of this individual’s Mother and Father was not provided)



You have not obtained sufficient points to satisfy me that you will be able to become economically established in Canada.







Subsection 11(1) of the Act states that a foreign national must, before entering Canada, apply to an officer for a visa or for any other document required by the regulations. The visa or any other document may be issued if, following an examination, the officer is satisfied that the foreign national is not inadmissible and meets the requirements of this Act. Subsection 2(2) specifies that unless otherwise indicated, references in the Act to “this Act” include regulations made under it.



Following an examination of your application, I am not satisfied that you meet the requirements of the Act and the regulations for the reasons explained above. I am therefore refusing your application.



Note: Any different or new information that you submit cannot be taken into consideration.




Now reading the bold line it says i have submitted the documents which was not that sure to make my mom's and my aunt's relationship as a real sister.

i was through an agent and he is saying to appeal against the decision...

if i want to re-apply i wont get the originals(some of them) back that soon so i can not re-apply that soon.


i have created the relationship documets again and i am going to apeal but still having confusion.. Will i make it???

because the red line i have mentioned above says different thing...

Please advice me.

Although I have given you as much help as possible and citing senior members you dont seem to want to read. All the appeal casses that I have read they have not submitted new Info. There is probably no harm to send it but I doubt they will consider it (according to the email). Why dont you send a PM to Viktoria and other applicants (in the post June 26 FSW thread) that have succesfully appealed a NER?

I think you lacked was info on their current immigrant status in canada and proof that they are living in canada (utility bills etc as explained on Qorax thread which I sent you yesterday).

Hi, in my case, i had sent my Mom's birth certificate as well as my aunt who is residing in Canada. Tax paid forms and Citizenship card copy, and her credit card statement copy too.

I think you lack to prove that currently your aunt is residing in Canada.


There is no harm in sending them the copies again. Try your luck brother.

she is my aunt, when i applied i put in file the following

sponsor letter from her
her passport
her utility bill
her bank statement

anything else i need?

That's correct. My understand is that they will not under any circumstances consider any new documents or information submitted AFTER they have made a decision.

They make their decision based on the documents and information that they have at the time they make that decision. If further documents are needed then from their point of view their decision was not wrong, because those documents should have been submitted in the first place.

So IMO the best course of action is to try to appeal to show that the information they had at the time they made their decision should have been adequate to prove the relationship.

As Rod rightly says, there is no harm in sending, it won't hurt - but I doubt they will consider it.

You can mention in your reconsideration letter that you are ready for a DNA Test to prove relationship

1. a covering letter stating all the conditions and telling that v r ready for DNA test
2. Family tree from village (pedhi namu)
3. my mom's pasport which is having her mother and father name
4. my aunt's passport
5. my aunt's electricity bill, telephone bill from canada
6. my aunt's tax certificate
7. bank statements of my aunt


anything more to submit u suggest????

Ur Aunt's PR or Citizenship card copy. And try to get her Credit card statement copy too. Just erase her card number on the statement before sending the copy.

I submitted less documents than you:
I submitted : PR card copy of my uncle, his birthcertificate and my father birthcertificate, passport copies of both.
my uncle doing nothing in Canada, means he is just relaxing and take care of cousins kids only, he was class 1 officer (Mamlatdar, deputy collector) so he and family people dont like that retired person work for this goriya log..

Nobody is giving you the right answer
1. They go by the mother's name you have not provided mothers name in the birth certificate also you did not provide your mother's birth certificate you only provided her school leaving certificate

2. Since you were not the principal applicant (I am not sure about this that spouse can claim points for relative)
