rejection of work permit

Hi everyone
I have applied open work permit for my wife in january and they rejected it as it is incomplete application. Again with help of a lawyer i applied visiting visa for her which also got rejected. Reason they mentioned is {your family ties in canada and in your country of residence}.

My status in canada work permit, full time permanent job (skilled level B), eligible for CEC in next 3 months

Please give me any ideas whether to apply again or appeal or wait until i get my PR.

Senior members please help me.

I've seen a few cases where Delhi denies TRVs but approves subsequent OWPs for the same applicant - doesn't make sense and I can't even guess why this is the case.

It's really unfortunate that your OWP application was submitted/completed properly, as that was your first and best chance to bring your spouse over.

I think now that you have two refusals, your case becomes more difficult. You could always try for another OWP (make sure you leave nothing out this time) but the visa officer may start to think your wife is just desperate to enter Canada. Perhaps it would make sense to wait until you apply for CEC and get confirmation of eligibility from CIC - then use that as part of your evidence base if your wife applies again for an OWP?

Thanks for your reply. Even i have the same idea. But i want to give a try before i apply under CEC (As it will be DEC by the time i apply and get a conformation #). But i have a problem of how to convince the officer that her intention to come to canada is only for her husband and not because of country. I have all the documents ready but i am waiting for some good suggestions to clear my doubts.

Do you know any situations like this or can you give me some idea.

when u gave incomplete apication of owp.Which documents you did not file.

I haven't seen a situation exactly like yours. I would say if you want to go ahead, just make sure the OWP application is as thorough as possible, and provide evidence that your wife has strong ties to India (whether it be a job, savings, property, family, studies, etc.).

Thanks for that. But as i have applied visitor, how can i convince them that now she want to stay for longer time but not short. and if i apply for an OWP why should i show strong ties to india ( As that is the reason they rejected visiting last time)

You can't undo the past or hide the past refusals. All you can do is move forward with the best application you can put together. The reason I suggested showing evidence of strong ties is that this will be the 3rd successive application made in order for your wife to come to Canada, and the visa officer could start thinking she's just desperate to get here. So cover all the bases and hopefully you'll be lucky.
