Hi to all and everyone who supported me through my ordeal I would like to thank you for your much support and advice,it is with a very heavy heart I bring this message to you.,.,.,., I think this is one of the saddest day for my wife and myself since we have been married,I got a rejection letter today,words cannot describe my wife feelings,she has done so much,getting things together for my arrival and was so excited up until the point the news came to her,I wish there is something that I can do to make her feel wanted, she is such a loving woman,.,.,. :'(
This is what the letter said.
You have been Convicted in the United States of America on 12th of October 1999 of an offence, namely, Operation after Suspension or Revocation.If committed in Canada,this offence would be punishable under article 259(4)of the criminal code of Canada.This was a ticket I got way back in 199 and the fine was not paid until recently, I thought when the fine was paid I would be on my way to my loving wife but my guess was wrong.I am not sure where it may lead but please continue to pray for my wife and our marriage.

What was the fine for? Can you pay it then appeal?

The fine was paid in January of 2016 and I provided that info to Imm Canada but I was still rejected.

I'm very sorry to hear this. I would try consulting an immigration lawyer, for advice at least.

Really sorry to hear this, yes your case is a bit on the complicated side, I would definitely say you need a good lawyer for this. It's sucks that something that you did back when you were a teenager, you probably thought it would just all go away and it's not a big deal, only to have it bite you in the behind 17 years later.

Yes - it's time to get a good immigration lawyer.

People are inadmissible to Canada until 5 years after they have completed a sentence/penalty for a crime (including paying a fine). If you only paid the fine this year, this technically means you are inadmissible to Canada until January 2021. At a minimum, you should have applied for rehabilitation. Have you done this yet? Even then, the rehabilitation application may not be successful since you paid the fine so recently. Again, time to hire a very good immigration lawyer to help. It's possible appealing may work - however your case is complicated and not a "do it yourself".

Thanks for the advice on seeking a good lawyer,I have been on this forum for the past 4 years saw and empathize with others who have been rejected by Imm canada,I do now see and feel their pain with the shoes being on the other foot,there is no words that can really describe our feelings at this point,my wife and I stayed away from work today,just trying to keep our composure and move on to the next step.However at the end of the letter it is noted as saying as a results neither you nor your sponsor may appeal this decision to the Immigration Appeal. This statement means I cannot appeal this decision?Anyone with experience can shed some light on this.

It does sound like appealing is not possible based on what you have said. Perhaps this is because you are inadmissible and don't qualify for rehabilitation? I don't know for certain. Again, this is where an excellent immigration lawyer should be able to help.

I see from your history that you received a letter from CIC last year indicating that they had found you inadmissible and not eligible for rehabilitation. How did you respond to this letter?

I had hired a lawyer to handle the matter of the unpaid fine in the U.S. January 2016 he then forward that info to CIC thinking that it would have been ok concerning the inadmissiblity.I think that they found me inadmissible to Canada under the grounds of the unpaid fine.

Thanks for the advice,I spoke to an Immigration officer today and was informed of my chances appealing is next to none. I do fall under sec36(1)b or c 259(4) A64(1)criminal inadmissibility immigration & refugee act where there is no provision under that act for me to appeal, so in essence I lose my right to appeal,only if I can change the hands of time,it all started some 17 years ago where I was caught driving without my insurance in the U.S. and a fine was imposed that was never paid until recently,I was advice after having paid the fine I would have been declared inadmissible to Canada for the next five years, so there goes my future in Canada for now I guess.Again I would like to thank everyone it was a great experience being on this forum I have learn a lot. God bless everyone and I will pray that everyone receive their PR soon. :'( I am at the end of the road now,please pray for my marriage and that I can come to Canada and reside with my loving wife some day.

I'm sorry it has turned out this way for you. I would consult with one or two more very experienced lawyers to be sure there's nothing you can do.

And yes - the issue is that you waited so long to pay your fine. If you had paid it 17 years ago (or even 5 years ago) the situation would be very different. Because you didn't pay the fine until very recently, there's still years to go before you will qualify for rehabilitation.
