I am living in winnipeg i filed my case 2010 got rejection 2012 filed appeal december 2012 got full hearing in aug 2013 i need help from you guys my reason of refusel was i submit divorece which was valid before my marriage and during immigration process embassy asked me arbitrition council certificate so i regiter in counsil at that time which was after my marriage date they objection on that like marriage was not valid then i filed appeal and got again marriage before submit the appeal now i am going full hearing and i am so worry what kind of question they asked me during hearing and how many chances to win the appeal what kind of proof they asked me did they call my spouse overseas please anyone who has experience e mail me and help me as i am so nervous and very upset on that situation. are they call to my hubby on that situation or not and its full day or half day hearing . anybody experience please reply me .

It sounds like CIC is saying your marriage may not be legal because there was no divorce, or the divorce is not legally recognized.

This sounds like a very complicated case. I can't imagine trying to do this without a lawyer.

If your income is low you may be entitled to legal aid or other legal help at a reduced cost.

They do not call your husband. You can call your husband as a witness, but you will have to tell the Immigration Appeal Division and the Canada Border Services Agency that you will be calling him as a witness, and you will have to bring in a phone card with at least 2 hours of time on it. The IAD should send or have sent you info on how to present your evidence.
If the PR rejection was only because of the divorce question, that is what the questions will be focused on. If the visa officer also thought your relationship is not genuine, they will ask about that too.

The problem with the divorce and remarriage can sometimes be resolved fairly easily, so in your case I would get a lawyer to help you. You will have to quote laws from your country to show your marriage is legal. It would be best to have an immigration lawyer prepare your case.
