Regarding to include spouse or not

Hi,

I am on post graduate work permit and my spouse is here on spousal open work permit and I am going to create my express entry profile soon but what I see is if i include my spouse my points are getting less so can I apply without my spouse ???

And the other thing is if I select that I am married is it mandatory to include spouse in my application????
Please help

If you select you are married the system will ask for your spouse information and he will have to take all the steps along the procedure. this is regardless of what you chose on the option accompanying/non-accompanying.

If you don't list yourself as married you risk that CIC finds out and this will definitely cost you more than just 20 points below ..

It has 2 questions
First is r u married or in common law relationship?? Where I will say yes
And second is
Is your spouse coming with you and there if I say no then its not asking me questions regarding spouse??

So what you think is it OK to say no in second question or cic will have a problem with it??
Please help if u can

If you are married, say yes for married. If your spouse is not accomanying, say No to that question. It is not necessary that your spouse has to accompany you.

But still the points are the issue here as far as I understand. So are tthe points considered as for you and your spouse if he/she is not accompanying you? I think so..

Since you are married, you have to say yes and would loose points (since a spouse has to have ECA / language test etc to qualify those points).

Accompanying or not doesn't matter for the sake of points.

If you do not do exactly as above, this would be misrepresentation and you would never be able to sponsor your spouse. Besides, you could be banned for 5 years and your PR can possibly be revoked. So you don't have a choice.

Are you sure about that?

In my case, I have 441 points if I say that my wife is coming with me and 468 points if I say that she wont. But in both cases I said that I was married.

Hmm ... well i haven't tried modifying points to see what actually happens.

But here is the detail you should know well - which i have no doubts about.

If you state your status being married but not accompanying and that does not make you loose points, well people would just do that to get PR ( e.g. 430 vs 468) might make all the difference. Latter when your spouse applies that is spousal sponsorship, not express entry and no points calculation involved.

Furthermore they have to undergo medicals now - because latter they would be Excessive demand exempt i.e. if you are spouse of a PR and even if you have a health condition which puts excessive cost burden on Canadian healthcare system, you still would be given PR and would be EDE.

However, right now when applying for EE - you are not. This is the reason your whole family (spouse and kids) have to undergo medicals now - even if they are not accompanying. Having such a health condition (even of a non accompanying dependent) might cause refusal for PR for the entire family.

It is possible that CIC reviewed their system for some reason and are now allowing one to score points as a single candidate EVEN IF they are married but spouse is not coming along now. But in the light of above, it doesn't look likely and is more like getting your way around covering the points gap.

So i would be surprised if CIC lets you do this.

The problem is, the OP's spouse is already in Canada on a dependent open work permit.

You would be asking CIC to believe that your spouse would LEAVE Canada if you get PR status. I think that is unlikely to succeed.

My advice would be to find ways to increase your spouse's contribution to the points. Has she taken a language exam? Gotten her educational credentials assessed?
