regarding regular study of dependant children over 22

hello sir
when i had applied for skilled worker for permanent visa in 2004 my two childrens were of approx 17 years old and were regularly studying and dependent
but now they r like 24 year old
so is there still a need to keep study continue or there is a age lock system


sir plz guide me
i will be very thankful
will be waiting for ur reply

Their age is locked in so they do not have to continue their studies but they must stay single, if they get married, they are not classified as dependent children any more.

one thing more i want to clear
like i have applied for permanent resident in federal skilled worker in 2004 my two childrens were of age 16 and 18
then in 2009 then send us a letter that they are processing our applicatin
and then also enquired for my elder child from his college becuz he was above 22 then
and we havent recieved a medical yet
so is there a need to keep his study countinue
and will the age lock factor work in our case or not as i have submitted my application in 2004

sir plz guide me about this

They shouldn't be asking about college. Their age should be locked in. Read the operational manual at http://www.cic.gc.ca/english/resources/manuals/op/op02-eng.pdf and especially page 18 where it says:

Dependent children under 22 years of age
• Is under 22 years of age and not a spouse or common-law partner
when the application is received by CPC-M; and
• without taking into account their age, they continue not to be
married or not involved in a common-law relationship at visa
issuance and when they enter Canada.
Also look at pages 15 and 16 where it says:

5.13. Who qualifies as a dependent child?

R2 and Section 6 in this chapter describe who qualifies as a dependent child.
In order to meet R2(b)(i) of the definition of “dependent child”, a child must be under 22 years of age and not a spouse or common-law partner on the date when the IMM 1344AE is received by CPC-M, and not a spouse or common-law partner when the visa is issued, and when they arrive in Canada.

Not a spouse or common-law partner means that the dependent child must not be married or
involved in a common-law relationship. A dependent child who is single, divorced, widowed, or whose marriage has been annulled is not a spouse. Similarly, if the dependent child was involved in a common-law relationship but that relationship no longer exists, they may be considered to meet the definition.

R2(b)(ii) & (iii) describe children over the age of 22 who may be considered dependent children if they are substantially dependent on their parents for financial support. This includes full-time students enrolled in accredited post secondary institutions or children with a physical or mental condition. In such cases, officers must ask for documentary evidence of full time attendance at school, evidence of the institution's accreditation with the relevant authority, evidence of the physical or mental condition and evidence of financial dependency on parents.

hello mr leon thanx for ur help sir

like i have applied in 2004 for permenant in skilled worker category but in 2009 the ambesesy sent us a letter that we r starting prosessing ur application now u can refund ur fee if u want now
and in 2009 the ambesey officer also called at the college and the clerk of college told themm that he studies over here

so i have a doubt that when they have locked my child's age in 2004 when we submitted our application or in 2009

when we check our application status they say we haye started processing ur application on august 2004
and is there a need to keep study countinue or not

plz sir help me out
i am really worried as my childs courses r almost over


i will be eagerely waiting for ur reply

Go to the link I gave you, print out the pages I told you about, highlight the text where it talks about children under 22 at the time of application, send that to the visa office and request information on your case, if the age of your children is locked in or if they should still be studying full time.
