My name is Mohammed .I came to canada on study permit on 27th April 2011.I completed my studies and graduated on 27th April 2012.I applied for Post Graduated Work Permit on 21st June 2012 and got work permit from 27th July 2012 to 27th july 2013(1 year)

I started my job on 17th June 2012 as Kitchen DesignerNOCB and my one year will get completed on 17th june 2013.I want to apply for Permanent residence under Canadian Experiance Class.I called CIC about knowing my eligibility and they told me that one year will get counted from day you recieved your post Graduated WorkPermit not from the day you started job.

As per CIC Website:
Note: Any periods of self-employment, unauthorized work, or periods of employment during which you were engaged in full-time study (e.g. work experience gained on a co-op, off-campus or on-campus work permit) will not be included when calculating the period of qualifying work experience. You must have had temporary resident status during the period of work experience acquired in Canada.

I started my job on 17th june 2012 and at that time i was not full time student so i want to know why that experiance willnot count or on 21st june 2012 i applied for Post Graduated Work permit and while waiting for that i was doing job so why that period will not count.

Please clearify this and mail me back as i have to apply my permanent residency under Canadian Experiance Class and has to apply for Bridge Open Work Permit.

CIC officer is correct your one year is start to countdown from the day you got your work permit. (Because from that day you got legal authority to work) the one month when you work without work permit is not countable. Best thing you can do apply renew your work permit. Meanwhile apply under CEC. I meant after July 27.

Make sure you count the experience from the later of your work permit and graduation diploma date. CIC will count the experience only from the official date of the certificate of graduation.

I could be wrong on this but your work experience between 6/17/2012 to 7/27/2012 may be considered as an "unauthorized" work.
I was in the same shoe as you. I got a job before my PGWP came in. I remember calling CIC, asking if I can start working while my application for PGWP is in process. Their answer was a "no". So I would suggest you do not mention it at all to avoid a red flag, and apply for CEC after 7/21/2013.

i was working legally full time on my off campus after graduation and when i applied for PGWP i was on implied status and working.Please somebody advise me i can file PR on 18th june or not.

I was working legally on offcampus full time after my graduation and it is legal and working while applying PGWP is also legal dear.

Hi Mohammed, unfortunately, there are many like you in this position, but CIC continues to be unclear and contradictory about it. For what it's worth, I agree that you should be eligible from 18 June, but unfortunately I am not a VO.

Most people on this forum agree, that the safest course of action is to interpret the rules conservatively, and wait until you've done a full year on the PGWP, after graduation. That leaves no room for error or refusal (over that one point).

Unfortunately, not everyone is in a situation where they can put in those extra 1-3 months, because of expiring work permits, etc. If you have absolutely NO OTHER CHOICE, and decide it is worth the gamble to you to apply, you can try. You might want to add a written explanation of how you calculated your eligibility (started working after graduation). But no one here can tell you with any certainty that it will be accepted.

However, I would also tell you that you would be better off asking your employer to apply for an LMO, obtain a new work permit, and work a few more months before applying for CEC.

So - have you asked your employer about the LMO? Since you are currently on a PGWP, it would be a relatively simple and painless process...
