Regarding DLI Change prior to new rules.

Hello everyone,
My wife came as a student in 2024 with a study permit issued for two years from centennial college. However due to change in the spousal open work permit laws we changed the DLI to International business university MBA program in the same city, Toronto, immediately and she started her course in May 2024 itself and has already completed 3 semesters.
Based on her study permit I was also granted an open work permit just recently.

The question is that someone just recently told us that we had to inform IRCC that we changed our DLI but we didn't know that at the time and now after the new rules on 8th november 2024 there is no place on the portal to update the DLI as earlier.
What should I do in this case ?

I already got issued the open work permit which means her student permit is active and fine. The college she goes to also doesnt have a problem as it shows them also that her student permit is active and legit.

We will be applying for her PGWP in a few mths and subsequently my open work permit extension as well. Will there be any issues or if anyone can shed some light on this please. Thank you so much

Did she complete a semester at Centennial?

A student always has to notify IRCC if changing DLIs that is not a new rule. She cannot change DLIs, she must apply for a new study permit. Just because you got approved doesn’t mean that her studying without a permit at the current school will be an issue. You were issue a permit based on her studying at Centennial. IRCC would not know she changed since she didn’t inform them.

She may very well be refused a PGWP for not informing IRCC and studying and working without a permit. She must meet new rules for you to get SOWP too.

She always had to get a new study permit if she never intended to go to Centennial. That rule has been in place for a few years now. She had to do that in May. If she had studied for a semester and then informed IRCC before November she would have been okay. Now she has been studying at a school not on her permit for many months. She cannot change DLIs. She needs a new study permit, and needs to explain in a letter why she didn’t inform IRCC and studied at a school not on her study permit.

The new rule in November applies to those studying at their school (Centennial) and changing DLIs (IBU). She never even studied at Centennial.

Thank you for this. So where does that leave us currently ? She has already finished 3 sems in college plus paid fees and also is already working currently. Further even I have a work permit now. So how do we approach this and what status will each of us have now ?We both have visitor visas as well.

You need to speak to an immigration lawyer. If you were aware of the new rules for SOWP you clearly had been researching study permit policies.

She needs a really good lawyer. She doesn’t have a study permit for the school on her permit, never studied at Centennial, never informed IRCC and also has been working illegally too. You are okay and can work until expiry of permit.

She should not be studying or working at all. FYI - IBU will not care. They got their money.

Hello, Unfortunately i truly wasnt aware however that is not an excuse. Would yo recommend a trusted immigration lawyer if you know any please ? As we were already wrongly guided by a few in the past
