I’m inviting everyone whose application got rejected, to share their stories so that others might be aware of the reality of the whole process. To start with, I will share the side of my story.
I used to be a participant in this forum…not an active one but I have quite a post. If you will go back to my previous posts, you will learn more about my case. Due to my current situation here in USA, I decided to try Canada. I want to make things right from the very start so after a torrid research on the whole process of applying for federal skilled worker category; I still ended up hiring a lawyer to process my application. This is a reputable lawyer and I trust him, I feel connected with him and his fees are ideal. He is based in Canada.
I provided all the necessary documents that my lawyer asked me and I know these are all in the checklist. My total score is 72 based on our assessment. I have relative in Canada, my husband has a bachelor degree and I have more than 10 years of experience. To cut the story short, with this point and the presentation and completeness of my file the visa office still rejected my application. My whole world stop and the only thing in my mind is the word WHY. In spite of all my efforts, my honest and good intentions, this will be the result….so why. I can’t find an answer, I’m very confused. I am a victim here in US and now, another one. I told myself it can’t be. I have to fight this and this is wrong. I emailed my lawyer and got a respond right a way. He wrote a letter to the program manager and after 30 days, we received a reply that the decision is final and my file is closed and if I want, I could file a fresh application.
The reason for the refusal is that I don’t have one year of continuous work experience and I did not provide evidence that I have the required experience for NOC 1111.
I provided a detailed reference letter from my employer here in US in which, I am a full cycle accountant for more than 5 years now and the business card of the person who signed it. It is in the letter head of the company and my salary is indicated in there and even my number of hours to showed that I am a full time employee. I was hired as an accountant of this company and still an accountant to date. I am not a CPA but my course is Bachelor of Science in commerce major in Accounting. I also provided my employment certificate from Dubai in which I worked for 5 years as a Finance manager. I am not counting much on it as I don’t have a detailed reference letter.
With all of these supporting documents, they would give me this bs reason that I did not provide evidence and so again why…the only thing in mind is why. I prayed even harder this time so that God would guide me and help me find the answer and you know what, I found the strength to tell my lawyer that I want to appeal this and can he assess my chance if we file for judicial review. He told me that he will review my file again and he will go back to all my documents. After few days this is what he told me; he personally called me, “I want you to proceed with the judicial review, we have a very strong case, I cannot guaranty you anything but our case is strong, it’s your decision.” I said yes right away. This is enough for me. Now I feel great, I know the waiting time is up to 1 yr. but I am fine with it because I believed this is the right thing to do.
Win or lose, I’ll be happy because I did everything I can and I did not give up. I will consider this as just one of my great experience that no matter what, life must go on and we always have to move our feet forward. It is the simplest thing to do, move your feet one at time and in the end you will reach your destination. Good luck everyone, each one of us has its own story to tell, happy or sad it will help us to do better in life.
We are already in the leave stage and if granted, judicial review process is next.
