Dear all refused applicants, there is option to judicial review by canadian federal court. Should not you go for this?

All Seniors, Please give your feedback on this option.

Hi, I would say that it depends on the reason for which the applicant was refused.
You must keep in mind that CIC Officers have a level of knowledge and expertise, they've seen a lot. If for example they believe that you're not able to establish yourself in Canada, perhaps you're lacking something (education, work experience, language skills, etc.) so is it really worth fitting this at court which can be costly and stressful?
....in a case like this, I would rather improve my skills and re-apply in the future. The gov. will give you the option for an appeal but that doesn't mean that everyone must appeal.

Under IRPA, Judicial review is granted only if VO has made an error in law, not error in judgement (except violating the principal of natural justice).

As per standard law in Canada, everybody has a right to get education from canada. If sombody has sufficient funds, skill, education and paid fee but refused by vo that he is not satisfied. In such case should we go for court?

Hi Fazeel, I thought you meant PR applicants being refused. They have an option to appeal the decision.
...but if you mean applicants for study permits o visitor visas, it happens all the time that these are refused mainly because the CIC officer is not convinced that the foreign national will leave Canada after completing studies or visit, or not enough ties to their country of origin. In those cases, I've never heard of an appeal process, Applicants just try again at a later date.
I may be wrong, you may want to check CIC's website for information.
