Good day all.
After waiting 12weeks we got te unfortunate news that our application was refused due to the following reason:

The reason for the refusal was because the applicant was not able to demonstrate that he can adequately perform the work that he is seeking.
Has anyone Reaplied after a refusal like this? We worked thrue an agent and I have ample experience in the field, I even worked in the US in the same field.

ANY advice would be appreciated.

The NOC mentioned might need deploma. My agent however said it is not an absolute requirement. Was he wrong?

To IRCC it is. If you read the NOC, it tells you the educational requirements so most likely you work experience was not enough for a farm supervisor position. Order GCMS notes to confirm but suspect it is because you did not provide ECA. Tell your employer that your work permit was refused and find out what to do next. If you provided no educational assessments, certification and/or licensing then it is an issue. Work experience is not enough. Maybe talk to employer about filing another LMIA for farm worker, not supervisor.

Employment requirements

  • Agricultural service contractors usually require a university degree, college diploma or industry courses in agricultural studies and several years of experience related to the service offered.
  • Contractors providing certain services, such as artificial insemination and pesticide application, may require training certificates and provincial licensing.
  • Farm supervisors may require a college certificate or other specialized training in agriculture or livestock husbandry.
  • A course or certificate in first aid may be required

Was the work done legally in the US. Under what visa?
