Refusal of Student Visa for 3 years course after 10+2 (half of family in Canada)

Here are some things I don't understand in ur request fr a Student visa fr ur Bro and I think these r some questions that will be running in a CIC officers head too,

Ur a Citizen - then why dont u sponsor ur brother, instead going for a student visa. U say ur making good money so u shld not have a problem with tht.
Low Ielts score - Does he really wnt to study? can he manage the Canadian society?
Low marks - I have seen few cases in which a student has got student visa based on SOP,eventhough they got low marks. In ur case u wrote the letter of explanation fr ur Bro,this shows total lack of interest in ur bro's end

In my opinion, ur Bro sounds like someone who is spoiled and doesnt have a need to come to Canada,since he gets everything back home (or) may be he really wnts to stay in his home country and wnts to make a living there. Talk to him and know wht he really wnts to do .

If u still wnt to try a study visa, ask him to improve his Ielts score and ask him to write the SOP on his own,where he can show some passion towards his future. I would also suggest u to state that as a sister u r willing to support his education and stay only (do not mention anything more than that, things like ur parents on supervisa and so on.)

Even this forum is a good example abt ur brothers lack of interest. U shld not be asking all these questions, ur brother shld be doing it. A student who has interest will be doing it fr sure. I apologize if I was harsh in any of my statements. But this is the reality and u have to live with it

She can't sponsor him directly - that's why.

The only option available to sponsor him would be to include him as a dependent in a sponsorship application for her parents. However he would have to be 18 years old or under to be sponsored. Also, CIC is only accepting 5,000 parent sponsorship applications per year and the cap was reached a day and a half after it opened this year - and no applications are currently being accepted. Finally, she would have to meet the minimum income requirements to sponsor her parents, her brother and also to support her family here in order to qualify as a sponsor. So the process isn't that easy. And if her brother is 19 years old or older - it's already too late. He has to qualify for PR on his own.

Scylla pretty much explained why I can't sponsper him. Thanks for that. Really appreciate your help.

I know he is a spoiled one being youngest and since me and my sister left home, he is the only remaining child for mom and dad. I don't deny that part and not the one who covers his mistakes or non seriousness. The best I could do for him is advise him to study hard but I guess that wasn't enough. I'm in a situation feeling like giving him tight slap.

Anyway, I gotta find a solution so he is not left behind. Everyone in our family wants to see him settling down, have a good career like his two sisters.

I work in IT and I work for a really good company so no problem for me to pay his fees and support him.

You guys really think IELTS with good score and deferring to Jan session would work? Cuz, I am still thinking he can write a strong SOP plus show his computer related certification that he missed submitting last time, and original affidavit of financial support from me.

I really have no idea. All he can really do is try and hope for the best.

My suggestion is that he can finish his college in back home. While he is studying at college, he will take time to study about IELTS.
After graduation, he is able to show good grade(college) + good ielts score. And then he can study a master degree in Canada which can show he is a genius student. This option is much better for his future and safe plan.

1) What do you think if my brother manage to get good IELTS score hopefully this time, inside "letter of explanation" should we include we have improved IELTS score now and our mom & dad have super visa and they're visiting us sisters in Canada soon? Also, in "Family information" form there's a section specifically asking "Will they accompany you to Canada". Well, I don't see any point hiding about they're not coming. Still I want to know what you guys think.

2) If you apply again, does Immigration ban you for applying again and again? I read they do so in case of fraudulent docs but do they also ban in case they are sick and tired of you applying again.

1) You should declare in the application that your parents have a super visa and plan to come to Canada. Doing otherwise may be regarded as misrepresentation (i.e. lying in an application). Misrepresentation results in a refusal of the application and sometimes a 5 year ban from entering Canada as well. The fact your parents have a super visa will decrease the changes of approval for your brother's study permit since this will increase his ties to Canada and reduce ties to his home country. However there's really nothing you can do about that since he has to be truthful in his application. Dental15's suggestion is a good one. His chances of approval should substantially increase if he completes a college course in his home country with high marks first (along with higher IELTS scores) - and then reapplies.

2) Bans are for fraudulent documents and misrepresentation (lying or leaving out critical facts in your application). Applying multiple times doesn't get you a ban. However the more refusals you have the more difficult it typically becomes to be approved in the future.
