refusal letter under CEC category

Hi, what course of action need to be adopted when an application is refused under CEC category due to incorrect NOC code? please advise... could an application be resent or a letter could be provided as consideration under current application.... would appreciate your info...

Can you clarify? I can't imagine that it was refused simply for an "incorrect" NOC code, but possibly because the NOC was not Skill Level O, A, or B..?

The NOC code provided in my application belong to the skill level C category as I had just started working. However, I do have experience in skill level B since the last year.. the advanced experience that I have gained since the last year was indicated with NOC code pertaining to skill level C in my application as I was just gaining advanced experience in my field.

I have now received a letter from CIC stating that the skill level C specified in my application do not qualify under CEC.. However, the fact is I do have experience with skill level B.. would a letter from the employer stating a brief discription of my job would suffice?

please advise...

So what is your situation exactly?

If your work permit is for a C skill level job, then you will not qualify for CEC.

If you are on an open post-grad work permit and are applying as a graduate with 2 years of studies and 1 year or more of skill level B work even though you are now working a C level job, you should appeal their decision since in that case, you would qualify.

You will need 2 years of in-Canada experience at skill level B to qualify for CEC (unless you were also a student, as mentioned by Leon - different requirements). And you won't get credit for skill level B experience if your documents are for a skill level C position (you are supposed to get a new LMO/Work Permit if the job changes, BEFORE the job changes).

However, if you can document 1 year of employment at Skill Level B and your employer is willing to provide you with a permanent job offer at Skill level B, you may qualify under the Skilled Workers program (Cat 2, Arranged Employment).
